Referring to the new government’s commitment to human rights and rule of law, Suhakam chairman Razali Ismail said every individual has the right to freedom of movement including to travel overseas.
“Suhakam defends the principle of the right to freedom of movement.
“While understanding the complications of the current situation and matters relating to national interest, Suhakam further advises in the public interest that the circumstances justifying the prohibition to travel will need to be provided,” he said.
Razali added that the Immigration Act 1959/63 did not provide the conditions under which the right to freedom of movement may be limited.
“Therefore, conferring an unfettered discretion on the director-general to decide on the right to freedom of movement of an individual would not be in line with international standards.”
He called for the relevant law to be amended in order for it to be in compliance with international standards.
Razali is believed to be referring to the issue of various individuals being barred from leaving the country, including former prime minister Najib Razak and his wife Rosmah Mansor, as well as other senior government officials who were said to have blocked investigations into the 1MDB scandal.
Prime Minister Dr Mahathir Mohamad had previously said that he had instructed immigration officials to bar Najib and his wife from leaving the country.

ReplyDeleteThese are not ordinary flight risks. The individuals involved are wealthy and well-connected overseas.
DeleteThey have a strong incentive to flee and not return to Malaysia.
They are not under arrest yet, so you can't claim that their rights are being violated.
Contrast the Previous Regime which banned Ambiga, definitely NO flight risk, from going overseas to accept an international award, for political reasons.
Ktemoc was as quiet as a mouse then.
then, my protest was not needed as there were plenty, Bar Council, this, that - I only raise my voice when none was forthcoming

ReplyDeletei was talking with my fren frm surabaya who wished they have a law like ISA. i told him it is a double edged sword. it can deter suspicious threats but it can also b abused politically. if u must have such a law, make sure u have in place a system dat can enforce it more fairly.
But then if it can be used on kaytee, pauline hanson and i would be very happy
DeleteAnyone reading the now unclassified AG’s report and still think these suspects are not flight risks is either dumb or stupid. See how difficult it is to bring back Jho Low, Jasmine Looi, Casey Tang and the former SRC CEO.
ReplyDeleteIs Suhakam now facilitating suspects in crimes to escape?
ReplyDeleteI smell something not right here.

DeleteNostro piggy piggy pig. Prove me wrong
You mean crimes like Maminco, Perwaja, BMF, Bank Negara forex, Malaysian Airlines and PKFZ?

DeleteBe a man! Have some bola2
Mahathir just replace the MACC head with his own sycophant. Even if got bola, whoever reports will be thrown out the window.
DeleteUh oh. Suhakam will soon have a new, "more compliant" chairman.
