Shafee: MACC has been caught with its pants down
KUALA LUMPUR: The Malaysian Anti-Corruption Commission ( MACC) has been accused of trying to scuttle Datuk Seri Najib Razak's right to a fair trial.
The former prime minister's lead counsel Tan Sri Muhammad Shafee Abdullah said the graft busters had done this by blocking his client's access to information about his own bank accounts.
He said MACC had done it with "no basis of any law", and had therefore abused its powers.
"This is oppressive, clear abuse of power and victimisation by the MACC against Najib," he said.
Shafee said this when submitting on the basis of his complaint against MACC for preventing Najib from getting information about his AmBank accounts without the green light from the agency first.
The senior lawyer had complained about the issue earlier this month and the parties were told to submit on it today.
Shafee said after he raised the issue in court, MACC suddenly allowed the bank to provide the information which was required.
However, he said the defence still wanted the court to make a ruling to prevent a similar situation from recurring.
Deputy Public Prosecutor Datuk V Sithambaram, however, contended that since the documents had been obtained by the defence "it should be the end of the matter".
He argued that the court should not interfere as MACC had its own powers and its investigations were ongoing.
He also dismissed claims that the accused was not getting a fair trial because of what the MACC had done.
Shafee then countered that he was not saying the MACC should be prevented from pursuing its investigation.
"All we are saying is that they should not stop us from doing our homework.
"This is a clear cut abuse of power and they (MACC) have been caught with their pants down," he said.
Judge Mohd Nazlan Mohd Ghazali will rule on the issue after lunch.
The MACC had shown unreasonable bias and is acting like a lackey of the Pakatan Govt. The MACC must be disbanded and the officers retrenched completely for this assault against open democracy. Make this an issue in GE15: Abolish the MACC.

ReplyDeleteJibby’s defence lawyers now trying to insinuate Joanna Yu, Jibby’s AmBank relationship manager, was a rouge banker working in cahoots with Jho Low to fool Jibby and AmBank.
Put the blame on an innocent employee who was just trying to do her job fulfilling Jibby’s banking needs while meeting all banking laws. When Jibby’s accounts were overdrawn, Joanna did her best not to allow Jibby’s checks to bounce by repeatedly contacting Jho Low to step in with new funds. She was just doing her job.
And the reward she gets from Jibby now is to be painted as a rogue banker. And she was sacked by AmBank and remains unemployed to this day.
Yes, All’s Fair.
And I am waiting patiently to see when the AmBank founder’s murder in July 2013 (Hussein Najadi) will be dragged into the picture....ha ha ha...perhaps Tommy is reserving that for the Mother Load case....1MDB.

ReplyDeleteIs politiking part of a defence counsel job in defending his client against criminal charges of corruption and money laundering?
The defense counsel seems to be sidetracked from his actual professional defence counsel duties required of him and instead depending more on the guidance given by his client.
Just go and look at all the charges levied against his client and how the Defense Counsel is performing in putting up a credible defense of the client in Court and all the new and inexperienced young advocates and solicitors would even be laughing and cringing behind his back at his professionalism.
Is the defense counsel majored in Criminal Laws or majored in Politics?
Or does he thinks he is still undergoing training in a Moot Court?
I wonder how much the Defense Counsel is paid for all these by the Client in defending him?

This just goes to prove that Najib's trial is being conducted impartially and even-handedly.
ReplyDeleteThe relationship between Prosecution and Defence is inherently adversarial. Its not the Prosecution's role to be nice to the Defence or give them free passes.
However, if the Prosecution acts beyond the bounds of what is just, the judge has the duty to rein them in, which he has in this case.
AMBANK = AngMoBank = CIA Bank. Never ever trust AngMoBank....opening your books to be manipulated by CIA lackeys....
