Teoh Beng Hock' death - delay in justice is injustice

LETTER | Twelve years have passed since Teoh Beng Hock's demise at the hands of the MACC at Plaza Masalam and yet no one is prosecuted and punished accordingly for causing his death.

The previous investigations failed to uphold the rule of law when the police and the Attorney-General's Chambers (AG) blatantly dismissed the decisive pre-fall injury on Beng Hock's neck that signified the criminal element of the incident. The pre-fall injury was the main reason that led to the ruling of the Court of Appeal that one or more unknown persons caused the death of Beng Hock.

The Teoh family and the public have been waiting for justice to come by throughout the reigns of BN, Pakatan Harapan and Perikatan Nasional. Since the case has been reopened for investigation in July 2018, we have been calling the authorities to classify the case as murder or culpable homicide. Our calls on the police, the AG and the Ministry of Home Affairs to reveal the investigation results have fallen on deaf ears for almost three years.

Delay in justice itself is a huge injustice to the victim's families and society. We call on the government to delay no more and every effort must be made to track down the perpetrators in a thorough police investigation.

No one should be spared in the investigations so that there will be no allegations of a cover-up. The investigation result should be made public immediately and the perpetrators must be brought to justice.

Therefore, in conjunction with the 12th anniversary of the passing of the late Teoh Beng Hock, the Teoh Beng Hock Trust for Democracy will organise several activities to commemorate the tragic incident and continue to remind the government and the public that the delay in justice is injustice itself.

    Keluarga Teoh Beng Hock hari ini kesal dengan kenaikan pangkat pegawai penyiasat Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) dan merayu kepada menteri-menteri di Putrajaya memberikan keadilan kepada kematian bekas pembantu exco Selangor itu.

    Dalam keadaan menangis, Teoh Lee Lan hari ini bertemu Menteri di Jabatan Perdana Menteri Datuk Wee Ka Siong di Parlimen dan menyuarakan kekesalan pegawai penyiasat SPRM yang terlibat dengan kematian Beng Hock dinaikkan pangkat.

    "Kami merayu, tolonglah lakukan sesuatu dan berikan keadilan kepada kami," kata Lee Lan kepada Wee dalam bahasa Mandarin.

    "Lebih teruk, dia (pegawai penyiasat SPRM) dinaikkan pangkat, kami mohon Wee sebagai menteri di Jabatan Perdana Menteri dan timbalan presiden MCA untuk melakukan tugas beliau," kata Lee Lan.

    Lee Lan turut mengingatkan Wee, MCA sebelum ini memberikan jaminan membantu keluarga itu mencari kebenaran dan membawa pembunuh Beng Hock ke muka pengadilan.

    "Kami sedih dan kecewa apabila menerima berita pegawai SPRM terlibat dalam kes siasatan Beng Hock dinaikkan pangkat.

    "Tidak masuk akal, mengarut, dan tidak boleh diterima," katanya.

    Kumpulan Teoh Beng Hock Trust for Democracy dan Pemuda Sosialis DAP Malaysia awal hari ini mengadakan demonstrasi aman di pintu masuk Parlimen menuntut keadilan kepada bekas pembantu Exco Selangor Ean Yong Hian Wah.

    Beng Hock ditemui mati pada pagi 16 Julai 2009 di tingkat lima, Plaza Masalam, Shah Alam selepas disoal siasat SPRM sehari sebelum kematiannya.

    "Selepas lima tahun, keputusan Mahkamah Rayuan memberikan kami harapan," kata memorandum yang diserahkan kumpulan itu.

    Sehubungan itu, kumpulan berkenaan menggesa polis mematuhi perintah Mahkamah Rayuan yang memutuskan pembunuh Beng Hock disiasat dan diambil tindakan.

    Mahkamah Rayuan pada 5 September mendapati kematian Beng Hock berpunca daripada "tindakan seseorang yang tidak dikenali yang tidak menurut undang-undang melibatkan pegawai di SPRM yang menahan dan menyoal siasat si mati."

    What a naive statement. Of course the cover-up happened the moment TBH died.

    I don't see the current or even future governments "enthusiastically" carry out a full and thorough investigation. It is not going to happen.

    That is the sad truth.

  5. At this juncture of the Covid-19 crisis, if MCA and Gerakan can swing some real practical help to those struggling in the Chinese community, they have a good chance to turn the tables on DAP.
