Bukit Gelugor MP Ramkarpal Singh says the mode of removal of judges is clearly set out in the Federal Constitution 


KUALA LUMPUR: Bukit Gelugor MP Ramkarpal Singh today said Prime Minister Dr Mahathir Mohamad’s defence of the Council of Eminent Persons (CEP) for summoning the top two judges to demand their resignations was ill-advised and against the rule of law.

In a statement, he said the CEP was appointed by the government, therefore its actions were ostensibly those of the government.

“When it summons judges and demands their resignations, it will be seen as the government demanding their resignations which is in complete disregard of the principle of separation of powers,” he added.


“It is a basic hallmark of any democracy that the executive does not interfere in the affairs of the judiciary.”

The lawyer said criticising the appointments of Chief Justice Raus Sharif and Court of Appeal president Zulkefli Ahmad Makinudin was not wrong, but it was “quite another matter to summon them and demand their resignations”.

“This is plainly wrong. The Federal Constitution sets out the mode of the removal of judges. This must be adhered to at all times in accordance with the rule of law.

“The CEP has clearly overstepped its boundaries in this case which cannot be condoned.

On June 10, Ramkarpal had said CEP chairman Daim Zainuddin should not interfere in matters where he had no standing to do so.

He was referring to reports that Daim had summoned the two judges to ask for their resignations.

The DAP MP said the removal of Raus and Zulkefli (who have since resigned) “must be in accordance with the rule of law, and Daim’s involvement in this (if true) is certainly contrary to the said rule of law”.

Mahathir had said it was not wrong for the CEP to have spoken to the top judges, adding: “They have the right to talk to a lot of people who are today innocent because they haven’t been charged. But they can give information that will lead to our taking action against a lot of people.”

    “I want to have [my case] set out and reviewed in court and to have it judged purely on the principles of law – this would show the beginning of the rule of justice in Malaysia”, he explained. ]

    Hmmm... Can the Federal Court reopen his case? The beginning of the rule of law? Interesting, is not..HY?

    1. 'Fully pardoned and exonerated by the King'.

      Came across this comment on social media ( took the liberty to post here ) :

      "By accepting pardon, it also means that you accept the guilty verdict. A full pardon only remits sentence but it does not overturn guilty verdict. Essentially, Anwar told a blatant lie to the public. Anwar was found not guilty for sodomy charge in his 1998 trial but was convicted for corruption. Technically, he did not serve the sentence for sodomy but corruption following the 1998 trial. He was put on jail for six years and released in the year of 2004. On his 2010 trial, however, he was convicted for sodomy charges. Technically, a conviction can only be overturned by higher court. The highest court of the land is federal court. Anwar's conviction for second sodomy charge was upheld by federal court. Legally speaking, his conviction for second sodomy charge cannot be overturned".

      But being pardoned by the King is totally different from being exonerated, the latter would mean being absolved from blame for a fault or wrongdoing. Absolved would connote clear, acquit, declare innocent, find innocent, pronounce not guilty, discharge...
