Court affirms 15-year jail term for man who sodomised fellow inmate

SHAH ALAM: The High Court here has affirmed a 15-year jail term and four strokes of the rotan imposed on a man for sodomising his fellow inmate at the Sungai Buloh prison four years ago.

Judge Ab Karim Ab Rahman said the offence committed by S Kalidas was serious, especially when the incident took place in a prison cell and while he was supposed to be under rehabilitation.


“The principle of retribution must be applied to show society’s abhorrence to such a crime which is also against human moral values,” he said in his judgment to dismiss Kalidas’ appeal against the conviction and sentence made by the sessions court.

The judge said public interest also demands that heavy sentences be imposed to serve as a deterrent to would-be offenders.




Karim said the seriousness of the offence was also reflected in how Parliament allowed for a maximum 20 years’ jail and whipping of up to 24 times for the offence.

He added that a lot of time and resources were wasted when the accused claimed trial, leading the prosecution to bring in 14 witnesses.

Kalidas, represented by Suvinder Singh, has filed an appeal to the Court of Appeal. Deputy public prosecutor Tengku Intan Suraya Tengku Ismail prosecuted.

Kalidas committed the offence on a 21-year-old man at around midnight on Oct 12, 2018.


He had warned his victim against telling anyone about the incident but the latter decided to report the matter to a prison warden.

However, the judgment today did not state the offence for which Kalidas had been imprisoned for previously, nor his original sentence.
