Sanusi’s lack of understanding on Constitution alarming, says Ramasamy


P Ramasamy chided Sanusi Md Nor for not understanding the separation of powers between the federal and state governments.

PETALING JAYA: Penang deputy chief minister P Ramasamy has criticised Kedah menteri besar Sanusi Md Nor, saying the latter’s lack of understanding of sovereignty as enshrined in the Federal Constitution was “alarming”.

Sanusi had claimed that a proposed regional authority to manage water resources in Ulu Muda would impinge on the state’s sovereignty and land rights.


Ramasamy, however, said that according to the Federal Constitution, it is the nation that has sovereignty and not individual states such as Kedah.

“Sanusi’s lack of understanding of the Constitution and separation of powers between the federal and state governments is confusing or alarming to say the least.


“This is not something expected from the head of the Kedah state government,” he said in a statement.

In an interview with FMT yesterday, Sanusi said that under the 1963 Malaysia Agreement (MA63) matters related to land are strictly under the purview of states.

In response, Ramasamy reminded Sanusi that state rights were enshrined in the Federal Constitution long before the formation of the MA63.

“As such any reference by Sanusi to the 1963 Malaysia Agreement might not be appropriate. In fact, he should refer to the Constitution of the country.”


Ramasamy urged the federal government through the environment and water ministry to undertake a study for the eventual establishment of a regional water authority.

“It is within the powers of the federal government to intervene on matters of conflict between the states.

“Water is a prime strategic matter that should not be left to the whims and fancies of mercurial state leaders like Sanusi. What is the purpose of having a federal water ministry that takes no initiative in resolving water problems between the states.”
