Court dismisses negligence
suit by dead navy cadet’s
family against govt
The sessions court rules that J Soosaimanicckam’s family failed to prove their claim of alleged negligence on a balance of probabilities.
In a brief ruling, judge Idah Ismail held that the family had failed to prove their claim of negligence on a balance of probabilities.
The court ordered the family to pay the government RM10,000 in costs.
Lawyer Zaid Malek appeared for Soosaimanicckam’s family while senior federal counsel Nur Ezdiani Roleb and Abdul Hakim Karem appeared for the government.
Zaid said the family would appeal today’s decision to the High Court.
Soosaimanicckam’s family filed the lawsuit against the government and 14 others for allegedly failing to provide him with timely treatment.
They also claimed he was abused by several individuals named in the suit.
A post-mortem report showed that Soosaimanicckam died on May 19, 2018 due to pulmonary oedema caused by leptospirosis, which he contracted during training.
Earlier this year, the Ipoh High Court ruled that Soosaimanicckam’s death was a homicide. The court found that his death was a direct result of the navy officers’ refusal to allow him to seek medical assistance.
