KL Tower revolving restaurant shut down after court order
Atmosphere 360 was ordered by the High Court to vacate their rented unit in KL Tower before Jan 4, 2024.
Menara Kuala Lumpur Sdn Bhd and its current owner Hydroshoppe Sdn Bhd had sought an order for Atmosphere 360 to vacate the premises before Jan 4.
PETALING JAYA: A well-known revolving restaurant in the KL Tower has been shut down by its management following a vacate order issued by the High Court in Kuala Lumpur.
In a notice sighted by FMT, Atmosphere 360 was ordered by the High Court to vacate their rented unit in KL Tower before Jan 4, 2024.
The order was sought by Menara Kuala Lumpur Sdn Bhd and its current owner Hydroshoppe Sdn Bhd against the restaurant owner, Asian Kitchen (M) Sdn Bhd.
When contacted, the CEO of Asian Kitchen, Ringo Kaw, confirmed the closure and said he was shocked upon receiving the notice.
“The High Court’s bailiffs appeared in our restaurant yesterday morning and ordered us to shut down, and there were a lot of customers dining at the time.
“Christmas and New Year celebrations are around the corner and our reservations have been extended to next year. So we have no choice but to offer our customers a refund. I feel really helpless.
“We hope the authorities can treat us fairly,” Kaw told FMT.
Kaw said prior to Hydropshoppe taking over the management of KL Tower, the previous management verbally promised the restaurant a three-year extension of its tenancy.
However, he said, the new management only allowed the restaurant to remain until the end of the year.
“We have also taken the matter to court because the takeover (of KL Tower by Hydroshoppe) is being investigated by the Malaysian Anti-Corruption Commission,” he said.
In April, Hydroshoppe director Abdul Hamid Shaikh Abdul Razak Shaikh was charged with allegedly offering an annual RM500,000 bribe over 15 years to former communications and multimedia minister Annuar Musa to expedite the takeover of the KL Tower concession.
Asian Kitchen then filed a suit against Menara KL and Hydroshoppe, seeking a declaration that the transfer of shares and ownership from the KL Tower’s previous owner, Telekom Malaysia Bhd, to Hydroshoppe was null and void.
They alleged the transfer of shares was “tainted with issues of illegality”, citing Hamid’s corruption charge.
Hydroshoppe then filed a bid to enter a summary judgment against the restaurant, seeking a declaration that the tenancy agreement between the restaurant and Menara KL had expired on June 30.
They also wanted Atmosphere 360 to vacate the restaurant unit.
The court ruled in favour of Menara KL and Hydroshoppe, prompting them to execute the summary judgment by asking Atmosphere 360 to vacate the unit.
