A PKR lawmaker has rebuked veteran lawyer Mohamed Haniff Khatri Abdullah for urging the Conference of Rulers to discuss Putrajaya's alleged refusal to admit and execute a royal addendum on Najib Abdul Razak's jail sentence.
In a statement, Hassan Abdul Karim said Haniff’s suggestion to involve the Conference of Rulers is a dangerous move that can lead to a constitutional crisis in this country.
Hassan (above) further said the questions raised by Haniff would also be answered in the court when it hears Najib's judicial review on the addendum, which ordered for the former prime minister to serve the remainder of his jail sentence as house arrest.
This includes whether the addendum was ever discussed in a Pardons Board meeting and if it satisfies Article 42(9) of the Federal Constitution, which stipulates that the board has to deliberate on any written opinion presented by the attorney-general.
"So, we will get the answer to these questions when Najib's judicial review is heard by the Kuala Lumpur High Court soon.
"Thus, I respectfully and humbly ask my fellow veteran lawyer Haniff to be patient. Do not be quick to blame the prime minister or the attorney-general.
"And most importantly, I would advise him to not drag our country into a constitutional crisis regarding this addendum issue. Let the court answer the questions," said Hassan.
Power of rulers
Elaborating, the government backbencher pointed Haniff to provisions under the Federal Constitution that stipulate the powers of the Conference of Rulers.
Mohamed Haniff Khatri Abdullah
According to Hassan, the Conference of Rulers does not yield such power to discuss the prime minister's alleged refusal as suggested by Haniff.
Instead, he stressed that the appropriate platform to refer the premier to is Parliament.
Yesterday, Haniff took to Facebook to appeal for the Conference of Rulers to convene a special meeting to discuss Anwar Ibrahim and his administration's alleged refusal to acknowledge the addendum order.
This came after Anwar acknowledged that the attorney-general did receive a letter regarding the royal addendum.
However, Anwar said after the letter was received, the Yang di-Pertuan Agong changed, and the attorney-general submitted the letter to Istana Negara to allow the newly appointed Agong, Sultan Ibrahim Sultan Iskandar, to make a decision - leaving out the Pardons Board and himself.
