An NGO has slammed the police after a case involving several TikTok videos allegedly spreading hate speech against the Malaysian Indian community was classified as requiring “no further action” (NFA).

Global Human Rights Federation (GHRF) president S Shashi Kumar said the police report filed in August last year showed that the videos touched on the 3R elements of race, royalty and religion.

He said based on correspondence with the police, the case was only referred to the deputy public prosecutor on Jan 9.

According to a letter sighted by FMT, the deputy public prosecutor’s office advised the discontinuance of the case on grounds that no crime was committed.




Shashi said the assertion that no crime had been committed was “utterly unacceptable”.

“This response reveals a blatant lackadaisical attitude and a troubling double standard when it comes to matters affecting non-Muslims,” he said in a statement.

“We have presented clear evidence, including three videos, that substantiates our claims against the perpetrators. The proof is undeniable – what more is needed?” he said, adding the NFA sent a dangerous message that hateful actions could go unpunished.

Claiming selective enforcement of the law, Shashi said non-Muslims were not only treated differently but were also subjected to unjust scrutiny while serious offences against them were dismissed.

On Aug 25 last year, MIC Youth and a number of NGOs urged the police to investigate the three TikTok videos, which claimed there was no such thing as an Indian race.

The videos allegedly claimed that “there is no Indian race but only one Tamil race”, ignoring the different Indian ethnicities such as the Telugu, Malayalee, Tamil, Punjabi, and others.

The videos also allegedly labelled Indian mothers as “prostitutes” and Hindu worshippers as “pigs”, and contained threatening remarks against India’s prime minister Narenda Modi.

The police report was filed by a concerned citizen, M Sivaneswary, at the Sentul police headquarters in Kuala Lumpur.

GHRF, MIC Youth, Malaysia Hindu Sangam, Kebajikan Masyarakat Sungai Buloh, One Malaysia Indian Association, and Persatuan Kebajikan India Otrumai Padai were also present to support the cause.
