MAVCOM to act against AirAsia X if passengers not compensated

IN line with the Malaysian Aviation Commission’s (MAVCOM) mandate to regulate economic and commercial matters relating to civil aviation in Malaysia and its commitment to protecting air travel consumer rights, MAVCOM had on Nov 11 issued a letter to AirAsia X Bhd (AAX) in response to its ongoing debt restructuring exercise.
This letter follows from MAVCOM’s various earlier correspondence with AAX.
In its letter, MAVCOM has clearly and unequivocally urged AAX to reassess its proposal to treat air travel consumers as creditors and to pay only 0.5% of the value of tickets purchased as announced on Oct 18.
MAVCOM takes the view that air travel consumers ought not to be classified as “creditors” as the air travel consumers did not, inter alia, sell any products, provide services or make loans to AAX but instead have paid monies for the purchase of tickets in advance of their flights.
Accordingly, MAVCOM reiterates its position that AAX should reimburse air travel consumers for the tickets purchased.
If AAX fails to reimburse the affected air travel consumers accordingly, MAVCOM will not hesitate to exercise its powers under the Malaysian Aviation Commission Act 2015 (Act 771).
AAX has repeatedly in its correspondence with MAVCOM and in their statements made to the public, given the assurance that AAX is committed to reimburse air travel consumers who were not able to fly due to flight cancellations.

Let me put the story in my own words (which means some rather flamboyantly naughty-cheeky words would be used in the following narration, wakakaka).
Some 2 to 3 years back, an AirAsia pilot (or two) used to write letters to the media ranting against MavCom and its clueless way of ballsing up AirAsia's business in Malaysia, controlling AirAsia's desire to expand here, contract there, etc.
No way, MavCom would say, probably asserting there were already far too many airlines operating on route 'X', etc etc, which AirAsia might have eyed.
Yes sir, MavCom regulates airlines economic and commercial matters in Malaysia such as route to be flown, number of passengers allowed, so on so forth, whilst CAAM (used to be Department of Civil Aviation of DCA) regulates the licensing and air safety operations of airlines (including that of pilots and engineering, loading-cargo-ing navigational competency etc).
So AirAsia was bollocking MavCom left, right and centre as a bureaucratic useless hindrance to sound airline business and by logic, ought to get out of good business companies' way, wakakaka.
Sweet Justice for MavCom - it'll now eff up AirAsia wish to offer credit to passengers instead of coughing up money already paid to AirAsia for service not met (not given flights booked) - no doubt the pandemic screwed AirAsia up but as MavCom said:

Transport Minister Wee KHAT Siong is so useless and unfair. Bailing out Malaysian Airlines MAS, YET AGAIN, now the total bailouts is what..... RM30 billion over the last 25 years....? But what help has our Air Asia received.....?

Because of AA, millions of Malay-sians got the opportunity to fly for the first time, overseas and locally. Thousands of East Malay-sians could "go west" looking for jobs.....because of AA. They could even go home for holidays, festivals and even elections to vote for BN gomen. Thousands of Malay-sian PR's in Australia fly back on forth on cheap AAX flights. So nice.
But when the pandemic struck what did Wee KHAT Siong do to help AA?
NOTHING.
Thousands of jobs lost. But MAS got bailed out yet again.

KUALA LUMPUR (Feb 22): Khazanah Nasional Bhd, the sole shareholder of Malaysia Airlines Bhd, has committed to inject RM3.6 billion in new capital into the national carrier's holding company Malaysia Aviation Group Bhd (MAG), to fund the group's business until 2025.
Last November, Finance Minister Tengku Datuk Seri Zafrul Abdul Aziz was quoted as saying that a total of RM28 billion had been injected into Malaysia Airlines by Khazanah to date.
The latest commitment follows Malaysia Airlines’ RM16 billion debt restructuring plan that was given the green light by the UK High Court today, with the deal set to complete by early next month.

Khazanah owns MAS, so which airline did you expect Khazanah to support? Besides, MAS as Malaysia's national airline is an iconic entity for Malaysia and Malaysians to support.

If Wee KHAT Siong is so “protective” of local shippers to sapot cabotage policy, how about protecting the thousands of jobs in aviation….ie AA? Useless fler.
Ordinary Malay-sians must sapot AA. This airline has given us the opportunity to fly. Whatever assistance MAS received, AA must receive too.
ReplyDeleteWee KHAT Siong, the cabinet and senior civil servants, who fly Business or First Class anyway, would love to see AA pokai and give MAS monopoly yet again. No more need to fly cheap.
Air Asia X is effectively bankrupt.
ReplyDeleteIt's liabilities far exceed its Assets, with no prospects for quick recovery of its revenue.
Ticket holders are unsecured creditors , and legally have the least rights, compared to Bondholders and Suppliers with enforceable contracts .
Up till today AA has not taken a Sen of taxpayers money. MAS has been bailed out half a dozen times, and taken RM30 billion. Sorry, national airline? Not worth paying 30 billion for national airline. If we can sell Proton to foreigner why not MAS?

GM of MAS is powerless under the thumb of Transport Minister, who all came from MCA.
DeleteMAS was the feeding pot for the cronies and VIPs, VVIPs all wanting to fly First Class. Departing planes have been known to wait for VVIPs who arrive late. Paid customers bumped off flights because Ministers and their entourage, family members must come first. Catering company owned by family of Minister paid 500% profit etc.
Mavcom is also staffed by many ex-MAS employees. They have an axe to grind with Air Asia.
