My fault and I’ll pay, says Najib after foul-up at chicken rice shop

FMT:

My fault and I’ll pay, says Najib after foul-up at chicken rice shop

Najib says he was ushered into the shop and admitted he did not stop to check-in while his officers did.

PETALING JAYA: Former prime minister Najib Razak who has come under fire for failing to “check-in” with the MySejahtera app before going into a chicken rice shop has admitted that he was at fault and asked authorities to fine him for his mistake.

In a video that has gone viral, the former prime minister can be seen being ushered to his seat immediately after he arrived at a popular chicken rice shop in Kuala Lumpur.

While his officers had “checked-in”, Najib said he did not, although it was unintentional.

“Never mind. I told the authorities to issue me a fine for my mistake and I will pay the fine voluntarily,” he said in a Facebook post, adding he would do so within seven days to get the “early-bird discount” rate of RM750.

“For me, there is no such thing as double standards.”

The Pekan MP said he did not want any issue raised about “double standards” in his case, although he could not say the same for other “parties or ministers”.

Najib’s post comes a day after police said they had opened an investigation paper into allegations that several ministers had flouted Covid-19 SOPs by crossing state lines for a wedding reception.

Among those named in the police report were finance minister Tengku Zafrul Aziz, science, innovation and technology minister Khairy Jamaluddin and federal territories minister Annuar Musa.

A few days ago, two lawyers and an MP also asked authorities to conduct an independent probe into housing and local government minister Zuraida Kamaruddin’s alleged movement control order (MCO) violation involving a cycling event.

The National Landscape Department said the event was not a “fun ride” as claimed on social media and that Covid-19 rules were adhered to at all times.

Najib appeals against ruling to pay RM1.69 billion in tax arrears
    Bernama -October 26, 2020

KUALA LUMPUR: Former prime minister Najib Razak has filed an appeal against a decision for him to pay the Inland Revenue Board (LHDN) RM1.69 billion in additional tax arrears for the period of 2011 to 2017 after a judgment in default was entered against him.

Najib’s lawyer Muhammad Farhan Muhammad Shafee said the appeal was filed a few months ago.

On July 22, the High Court had allowed LHDN’s application for a summary judgment to be entered against Najib.

Judge Ahmad Bache ruled that since the notice of assessment had been properly served to Najib, pursuant to Section 103(2) of the Income Tax Act 1967 (ITA), the tax payable under those additional assessments becomes due and payable to LHDN.

He said the defendant (Najib), to date, has failed to pay the total amount of arrears of additional income tax amounting to RM1,692,872,924.83, which includes all the penalties.

The judge further said under Section 106 of the ITA, the court found that the additional income tax was hereby due and recoverable as debt due to the government for an amount RM1,692,872,924.83, as evident in the certificate of indebtedness issued on Aug 5, 2019.

Article 48 (1)(e) of the Federal Constitution provided for the following:

    “Disqualification for membership of Parliament

    48. (1) Subject to the provisions of this Article, a person is disqualified for being a member of either House of Parliament if:

    (e) he has been convicted of an offence by a court of law in the Federation (or, before Malaysia Day, in the territories comprised in the State of Sabah or Sarawak or in Singapore) and sentenced to imprisonment for a term of not less than one year or to a fine of not less than two thousand ringgit and has not received a free pardon.”

Read together with Article 50(1 )of the Federal Constitution, the outcome would have been rather straightforward.

    Article 50(1) reads:

“If a member of either House of Parliament becomes disqualified for membership of that House his seat shall become vacant.”

In a nutshell, if a member of Parliament was convicted of an offence and sentenced to the threshold imprisonment or fine, he or she is disqualified as a member of Parliament and his or her seat shall become vacant.

KUALA LUMPUR (March 11): Veteran lawyer and lawmaker Karpal Singh was slapped with a RM4,000 fine for sedition by the High Court today.

After a two-hour hearing for mitigation and sentencing, Justice Datuk Paduka Azman Abdullah said that any sentencing needed to have some impact on the people who otherwise may not fear if an offence is committed.

“It is not denied that the accused a prestigious lawyer in Malaysia,

"But as a principle of sentencing, every charge must have an impact to the public. Otherwise they will not fear (if and when they have committed an offence).

"Due to his health condition, the court will not give him custodial sentence. (Karpal) is fined RM4000," he ruled.

The court had on Feb 21 found the wheelchair-bound DAP chairperson guilty of uttering seditious words against the Sultan of Perak at the height of the state constitutional crisis in 2009.

Karpal was convicted for saying that that the removal of PAS leader Datuk Seri Mohammad Nizar Jamaluddin and the appointment of BN’s Datuk Seri Dr Zambry Abdul Kadir as the new Menteri Besar by Sultan Azlan Shah could be questioned in court.

During submissions, Karpal's son and lead counsel, Gobind Singh Deo, called for a light sentence as the prime minister had announced a repeal of the Sedition Act.

He argued that since Karpal suffered from a cervical cord injury with no improvements over the past three years, the court should not subject him to custodial sentence.
