Shariah judge seeks RM30mil default judgment after Lokman fails to respond

KUALA LUMPUR: Shariah chief judge Na’im Mokhtar, who is suing former Umno Supreme Council member Lokman Noor Adam for defamation over remarks in relation to a sexual harassment case, has filed an application for a RM30 million default judgment.

This is because Lokman has failed to file his defence despite the High Court giving him an extended deadline until last Friday.

Na’im is seeking RM10 million each for exemplary, aggravated and punitive damages with 5% interest to be included until the judgment sum is paid.

FMT has sighted the application filed by Messrs Akberdin & Co at the registry yesterday, while counsel Akberdin Abdul Kadir, appearing for Na’im, confirmed the matter

A default judgment occurs when the defendant in a legal case fails to respond to a court summons or does not appear in court. If this occurs, a court may rule in favour of the plaintiff by default.

On Feb 7, judge Rozana Ali Yusoff ordered Lokman’s lawyers to file his defence by Feb 11, and for Na’im to file his reply, if necessary, by Feb 25.

Rozana also extended an ex parte injunction obtained by Na’im against Lokman from making comments and removing the alleged defamatory remarks against him.

While maintaining the status quo, the judge also fixed March 22 to have an inter partes hearing on the injunction.

Na’im, who filed the suit and sought the interim injunction against Lokman on Jan 19, claimed he had been implicated in several sexual harassment cases, including one where he was said to be lying nude in a bedroom of a woman’s home.

Na’im said Lokman made disparaging remarks against him on Facebook and YouTube.

He said the alleged defamatory statements implied that he was a “spiritual opportunist”, had failed to be a credible leader or set a good example for the community, and tarnished the good image of the shariah judiciary department.

He said he had lodged a police report on Jan 12 to deny the claim by the woman, said to be a “Datin”, and against Lokman over his posting of the videos.
