Gombak Setia rep's ex-aide convicted of rape, gets 13-year jail term

The Kuala Lumpur Sessions Court has convicted a former aide of Gombak Setia assemblyperson Hilman Idham of raping a woman at a hotel more than three years ago.
However, Mohd Zulfahimin Mahdzir has since appealed to the Kuala Lumpur High Court to quash the guilty verdict as well as the sentence of 13 years in jail and two rotan strokes.
He was accused of committing the offence in a hotel room at Sri Hartamas, Kuala Lumpur, between 1am and 3am on Dec 5, 2020.
Sessions Court judge Nor Hasnah Ab Razak ruled that the accused’s defence had no merit and failed to raise reasonable doubt in the prosecution’s case.
In the full written grounds of judgment released last week, she said the accused failed to rebut the testimonies of prosecution witnesses over the alleged incident.
The trial judge added that the 13-year jail sentence and two rotan strokes were appropriate as it was a “serious and heinous” offence.
Hasnah said the criminal court viewed seriously that the accused had allegedly taken advantage of the victim while she was drunk.
On May 31, Zulfahimin was found guilty under Section 376(1) of the Penal Code. However, he immediately appealed.
The accused is represented by law firm Kit & Associates.
Prosecution was conducted by deputy public prosecutors Zilfinaz Abbas and Fazeedah Faik.
