Apex court rules that the nine legal questions raised by Musa Hassan on a public officer's right to sue and freedom of speech do not warrant a review


Musa Hassan told a forum in 2020 that an unnamed group linked to DAP was trying to destroy Islam in the country, and claimed that Hannah Yeoh had written a book to ‘make this country a Christian country’.


PUTRAJAYA: The Federal Court has dismissed former 
inspector-general of police Musa Hassan’s application for leave to appeal a ruling that found him liable for defaming federal territories minister Hannah Yeoh.

A three-member panel comprising Justices Rhodzariah Bujang, Che Ruzima Ghazali and Azmi Ariffin held that the nine proposed questions of law raised by Musa lacked novel points warranting the court’s determination.

The questions concerned a public officer’s capacity to sue and the dissemination of speech.


The apex court’s ruling means that Musa must now settle a judgment sum of RM250,000 to Yeoh, in addition to RM50,000 in costs ordered by the court.

Yeoh filed the suit in 2020 after Musa alleged that she was seeking to turn Malaysia into a “Christian nation”.

Musa told a forum that an unnamed group linked to DAP was trying to destroy Islam in the country, and claimed that Yeoh had written a book to “make this country a Christian country”.

The Court of Appeal said in January that Musa’s remarks, made at a Universiti Teknologi Mara forum six years ago, were defamatory against Yeoh and made her a subject of ridicule among the Muslim community.

It also said that Musa had linked the “group” in question to Yeoh, insinuating that she was politically and religiously affiliated.

The appellate court held there was no evidence that Yeoh had used her book, “Becoming Hannah: A Personal Journey”, to propagate her religion or undermine Islam.

Lawyer Awang Armadajaya Awang Mahmud appeared for Musa, while Razlan Hadri Zulkifli represented Yeoh.
