PETALING JAYA: A 52-year-old man was sentenced to a total of 36 years in prison and 24 strokes of the rotan by the Sandakan sessions court today after he pleaded guilty to raping his step-granddaughter, who later gave birth to a baby boy.

Judge Zaini Fisher handed down the sentence after the man, a foreign national, pleaded guilty to two charges of rape, Harian Metro reported. His nationality was not disclosed.

According to the charges, the accused raped the minor at a village in Sandakan on Oct 13. Two days later, he repeated the offence at a village farm.

For both offences, the accused was charged under Section 376(3) of the Penal Code for rape and Sections 16(1) and 26(1) of the Sexual Offences Against Children Act 2017 for an offence against a person in a relationship of trust.

The court sentenced him to 15 years in jail and 10 strokes of the rotan for each of the two rape charges.

He was sentenced to an additional three years in jail and two strokes of the cane for each of the two charges under the Sexual Offences Against Children Act.

However, Zaini ordered the sentences to run concurrently from the date of arrest and directed that the man be deported to his country of origin after serving his sentence.

Based on the facts of the case, the victim and her two younger siblings lived with the accused and their grandmother after her parents divorced.

The accused was arrested at a farm at Batu 36, Sandakan, on July 23 after the victim’s mother lodged a police report claiming her daughter had given birth as a result of rape.

The prosecution was handled by deputy public prosecutor Azizi Hamil.
