Defence drubs attempt to link Guan Eng to assault on prosecution witness

DAP adviser Lim Guan Eng’s lawyers have accused prosecutors of insinuating that the politician was linked to the attack on a prosecution witness in the corruption trial.

Messrs Hajian Omar & Co claimed the case’s lead prosecutor Wan Shahruddin Wan Ladin had done so by saying that he was waiting on instructions from the MACC whether to place the witness under protection.

“While we admit the prosecution has a right to consider protective measures, any action must be based on true security concerns and not on speculation and unfair bias that tried to implicate our client (Lim) with the incident.

“Such speculation, whether by the media or prosecution, jeopardises the integrity of the judicial process and unfairly harms our client’s reputation,” the lawyers said in a statement today.

Yesterday, it was reported that 10 assailants had attacked the witness at his home near Petaling Jaya.

Police later said the attack was a robbery and not related to Lim’s case.


Didn’t consult police

Lim’s lawyers said this showed that Wan Shahruddin had not consulted the police before making “hasty” remarks about witness protection.

They said they would raise a complaint at the next trial date on Aug 19.

They also called on the media to ensure their reporting about the incident is factual.

Lim is on trial over four corruption charges involving the planned construction of Penang’s undersea tunnel and paired roads project connecting the island to the mainland.

He is accused of abusing his power as the then-Penang chief minister for the first charge to obtain RM3.3 million in monetary gratification as an inducement to appoint Consortium Zenith Construction Sdn Bhd to implement the project worth RM6,341,383,702.

On the second charge, Lim was alleged to have asked the company’s former director, Zarul Ahmad Zulkifli, for 10 percent of profits as a reward for helping his company secure the project.

He also faces two counts of dishonestly disposing of two plots of land belonging to the Penang government in Bandar Tanjong Pinang, worth RM208 million, to the tunnel project’s developer.

  1. The Prosecution as it is does not have a strong documented case.

    The Gold Standard in a Corruption prosecution - proof of alleged financial transactions culminating with the defendant has not been available, unless the Prosecution can spring a last minute surprise .

    What we have is the prosecution testifying the defendant demanded kickbacks, money alleged to be paid to a 3rd Party, but nothing provable that Lim Guan Eng received illicit funds.

    This is a far cry from the standard of corruption evidence provide in the SRC case, which is how Najib's conviction has stood even after appeal all the way to Federal Court.

    In the course of the public corruption trial, it has been obvious the key Prosecution witness is an extremely wealthy individual , which likely received attention from criminal elements which would make him a ripe target for robbery.
