'Datuk Roy', MACC officer charged over offence linked to Muhyiddin's son


A businessperson known as ‘Datuk Roy’ and an MACC officer claimed trial to two graft charges involving alleged inducement not to remand former prime minister Muhyiddin Yassin’s son.

Before the Sessions Court in Kuala Lumpur this morning, the man - whose real name is Mohd Hussein Mohd Nasir (above) - and Mohd Rasyidi Mohd Said made the plea to the joint charges that mentioned Fakhri Yassin Mahiaddin.

It is understood that Fakhri Yassin was never arrested by the MACC.

One charge is of allegedly soliciting cash of RM400,000 while the second charge is of purportedly receiving RM240,000.

The solicitation charge accused the duo of soliciting RM400,000 from one Dalena Berhan as an inducement not to remand Fakhri.

The second charge accused the duo of receiving RM240,000 from one Syed Farid Syed Al Attas for an allegedly identical inducement.

They were alleged to have committed the offences at two separate restaurants in Kuala Lumpur between March 5 and 6 earlier this year.

If convicted for any of the two charges framed under Section 16(a)(A) of the MACC Act 2009 and punishable under Section 24(1) of the same Act, Hussein, 53, and Rasyidi, 42, may be sentenced to a maximum 20-year jail time, fine of not less than five times the amount involved in the offence or RM10,000, whichever is higher.

Judge Azura Alwi then allowed the case to be transferred to another Sessions Court in Kuala Lumpur, where Hussein is expected to face another charge.

Azura also did not decide on the issue of bail as that would be decided before the other judge, Suzana Hussin, today.


Third charge

When brought before Suzana later this morning, Hussein claimed trial to a third charge of soliciting RM2 million from Siti Dalena and Syed Farid as an inducement linked to a separate criminal case against Bersatu Segambut deputy chief Adam Radlan Adam Muhammad.

The inducement was to allegedly lessen the criminal charge, alter a related witness’ testimony, and lessen the related bail amount involving Adam’s case.

Hussein was alleged to have committed this offence in Kepong, Kuala Lumpur, in February this year.



If convicted for this charge under Section 16(a)(A), he also faces imprisonment up to 20 years, fine of five times the amount involved or RM10,000, whichever is higher.

Suzana then set bail at RM15,000 with one surety for Hussein and RM10,000 with one surety for Rasyidi.

She ordered both men to surrender their passports to the court and for them to report to the MACC office in Kuala Lumpur until the disposal of their case.

Suzana also fixed July 20 for mention of the case.

Prosecution was conducted by deputy public prosecutors Wan Shaharuddin Wan Ladin and Nor Diana Nor Azwa.

Hussein and Rasyidi were represented by defence counsel Fahmi Abd Moin and Mohd Hezri Shaharil respectively.
