KUALA LUMPUR: A government MP has reprimanded the Malaysian Anti-Corruption Commission (MACC) for releasing a press statement on its investigation into Court of Appeal Justice Nazlan Ghazali, in which it said the investigation was completed.

RSN Rayer (PH-Jelutong) said the press statement left Nazlan with no avenue to defend himself.

“Therefore, I would like to reprimand (the MACC) and ask (the agency) not to issue any more statements like this since these would create ‘endless polemics’,” he said when debating the Supply Bill 2023 at the committee stage today.

On Feb 24, a seven-member Federal Court panel said the MACC’s investigation against Nazlan was carried out without following protocol.

Chief Justice Tengku Maimun Tuan Mat said MACC cannot publicise an investigation against a superior court judge without the chief justice’s prior approval.

Last September, MACC chief Azam Baki had said the investigation had been completed, though he did not reveal further details.

Azam also said he was not at liberty to disclose the Attorney-General’s Chambers’ instructions.

Nazlan, who presided over Najib Razak’s SRC International trial in the High Court, found the former prime minister guilty of abuse of power, criminal breach of trust and money laundering.

He sentenced Najib to 12 years’ jail and a RM210 million fine, a sentence that was then upheld by the Federal Court in August last year.

In his appeal in the apex court, Najib was prevented from arguing that Nazlan was under a serious conflict of interest when presiding over the trial. Najib lost the final appeal and is serving his sentence at Kajang prison.
