KUALA LUMPUR, Oct 15 — DAP adviser Lim Guan Eng has successfully had his international passport permanently returned, after previously handing it over to the court as part of bail conditions in the Penang undersea tunnel corruption case.

Sessions Court judge Azura Alwi granted the application, citing valid reasons and considering developments since the passport was initially surrendered.

In an affidavit, the 63-year-old former Penang chief minister said he needed the passport to carry out his duties as honorary chairman of the Asian Coalition for Asian Political and Institutional Capacity Development (ACAPICD).

He added that permanent release would allow him to fulfil work commitments without having to repeatedly apply to the court for travel, saving time and resources for all parties, including the judiciary.


Lim also emphasised that his RM1 million bail with two sureties remains in place and that he is not a flight risk, having never failed to attend any court proceedings.

The prosecution was represented by Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin, while Lim was represented by lawyers RSN Rayer and Ramkarpal Singh.

Azura approved the passport release but ordered Lim to report to the Malaysian Anti-Corruption Commission (MACC) office in Penang once a month, with his existing bail conditions unchanged.


Lim faces charges of using his position to obtain bribes from the director of Consortium Zenith BUCG Sdn Bhd, Datuk Zarul Ahmad Mohd Zulkifli, in relation to a RM6.3 billion project to build three main roads and an undersea tunnel linking Penang to the mainland.

The trial is ongoing.
