Labourer jailed 32 years
for raping, sodomising teen
daughter
The 51-year-old committed the offences when the girl was 15 in 2019.
A three-member panel comprising Justices Ahmad Zaidi Ibrahim, Azman Abdullah and Azmi Ariffin dismissed the 51-year-old man’s appeal to overturn his conviction and jail term on the rape and sodomy charges.
The court also allowed the prosecution’s appeal to reinstate the conviction for another rape charge, reversing a High Court decision to acquit him for that offence.
In dismissing the appeal over the rape and sodomy charges, Zaidi said there were concurrent findings made by the sessions court and the High Court. He also said the victim was a credible witness and her testimony was supported by medical evidence.
Zaidi said the imprisonment and whipping sentences meted out by the sessions court were not manifestly excessive.
On July 4, 2022, the Kuala Terengganu sessions court convicted the man of two charges of raping his daughter, then 15, and one charge of sodomising her at a house in Kuala Berang in Hulu Terengganu, Terengganu, between August and November 2019.
He was sentenced to 16 years in prison and 10 strokes of the rotan for each of the rape charges. He was also given a seven-year prison sentence and two strokes of the rotan for the sodomy offence. The prison sentences are to be served concurrently.
In July last year, the High Court upheld the man’s conviction for the rape and sodomy charges but acquitted him of the first rape charge.
The man was represented by lawyer Nadzir Abdullah while deputy public prosecutor Atiqah Abdul Karim @ Husaini appeared for the prosecution.
