Activist repeats call for rearrest of Nhaveen’s murder accused
The chairperson of the Nhaveen Action & Investigation League (NAIL) Arun Dorasamy repeated calls for the Attorney-General's Chambers (AGC) to apply for arrest warrants against the five accused while awaiting the appeal of the case involving T Nhaveen.
Arun made this request in a press conference held online today, citing concerns for the safety of Nhaveen's family and witness T Previin, as well as fears that the five accused might flee.
"...Simultaneously, arresting the (five accused) will bring some peace of mind to (Nhaveen's mother) Shanti Dorairaj, and Previin, ensuring their safety, and providing a glimmer of hope for the (appeal) process," he said.
He claimed that based on the information they have, they are worried that the defendants may try to flee the country through a lorong tikus (illegal border routes), and therefore, they have filed a police report.
Arun (above) noted that he had also previously asked the AGC to specify whether they were appealing the acquittal of the same suspects over a charge of voluntarily causing grievous hurt using dangerous weapons on Previin and had received an affirmative reply on the matter yesterday.
‘Family deserve justice’
Last week, the AGC confirmed the department has filed an appeal against the George Town High Court's acquittal and discharge of five individuals for the death of Nhaveen, who was allegedly killed due to violent bullying in 2017.
Judge Mohd Radzi Abdul Hamid gave the order to S Gopinaath, 32, J Ragesuthan, 24, and S Gokulan, 24, and two others, who were juveniles at the time of the incident, after finding that the prosecution had failed to establish a prima facie case at the end of the prosecution's case.
He said the court found that there were conflicting versions in the witness statements regarding several incidents and also the failure by the prosecution to call an important witness in the case, who is the victim's friend known as Preevin.
The five friends were charged under Section 302 of the Penal Code with murdering Nhaveen near the Karpal Singh Learning Centre in Jalan Kaki Bukit, Gelugor, between 11pm and midnight on June 9, 2017.
Elaborating, Arun emphasised that NAIL does not intend to interfere with the legal, trial, or appeal process, by constantly inquiring for constant updates on the case.
As the affected parties, Nhaveen's mother Shanti and Previin deserved justice, he said.
