Perikatan Nasional (PN) secretary-general Takiyuddin Hassan has no authority to issue a show-cause letter to Bersatu over a claim that the party’s Supreme Council does not have the required quorum to hold meetings, says a former aide to Bersatu president Muhyiddin Yassin.

In a Facebook post, Marzuki Mohamad said Takiyuddin should have sought clarification from the Registrar of Societies (RoS) about the matter.

“The PN secretary-general has no authority to issue a show-cause letter to Bersatu over complaints lodged by Bersatu MPs with the RoS regarding whether the Supreme Council had the required quorum to meet,” he said.

Marzuki said Bersatu has yet to receive any notice from the RoS concerning the matter, and as such, remained a legally recognised organisation and legitimate PN member when the coalition’s Supreme Council met on July 16 to finalise the allocation of seats for the Negeri Sembilan state election.

He also pointed to a statement by PN chairman Ahmad Samsuri Mokhtar on Aug 9, which he said acknowledged Bersatu’s status as a legitimate PN member.

Marzuki said Bersatu was therefore entitled to be invited to the July 16 PN Supreme Council meeting, adding that its exclusion constituted a serious breach of the coalition’s constitution.

He added that Bersatu’s Supreme Council had exercised its powers under Clause 27 of the party’s constitution to interpret what constitutes a quorum, and that its interpretation was final.

Marzuki maintained that any dispute over Bersatu’s legal status or the interpretation of its constitution should be determined by the RoS rather than PN.

Takiyuddin yesterday said PN will no longer invite Bersatu to attend the coalition’s meetings after the party was alleged to have only 23 members in its Supreme Council, falling short of the 25-member quorum stipulated in its constitution.

In a Sinar Harian report, Takiyuddin said four Bersatu MPs lodged a complaint with the RoS on July 13 over the claim, after which he sent a show-cause letter to Bersatu seeking an explanation.

Takiyuddin added that the matter should be determined by the RoS as it involved the interpretation of a party’s constitution.
