WASHINGTON: The US Supreme Court ruled Friday that Donald Trump exceeded his authority in imposing a swath of tariffs that upended global trade, blocking a key tool the president has wielded to impose his economic agenda.
The conservative-majority high court ruled six-three in the judgment, saying the International Emergency Economic Powers Act (IEEPA) “does not authorise the President to impose tariffs”.
While Trump has long used tariffs as a lever for pressure and negotiations, he made unprecedented use of emergency economic powers upon returning to the presidency last year to slap new duties on virtually all US trading partners.
These included “reciprocal” tariffs over trade practices that Washington deemed unfair, alongside separate sets of duties targeting major partners Mexico, Canada and China over illicit drug flows and immigration.
The court on Friday noted that “had Congress intended to convey the distinct and extraordinary power to impose tariffs” with IEEPA, “it would have done so expressly, as it consistently has in other tariff statutes.”
The ruling does not impact sector-specific duties that Trump has separately imposed on imports of steel, aluminum and various other goods. Formal probes which could ultimately lead to more such sectoral tariffs remain in the works.

LOL! SCOTUS’s ruling basically said Trump was using the wrong law for his tariffs, so Trump just issued the same tariffs under different laws and increased them by 10%.

ReplyDeleteThe Constitution says Congress will set Tariff policy & the President sets foreign policy. Congress passes 4 laws allowing the President to implement Tariffs. The President chooses one of these laws (used by Pres. Nixon) to use Tariffs to enforce foreign policy. 6 Supreme Court justices don’t like this law. 😳. So the President will simply choose one of the other 3 laws. What a waste of time. 🙄

Everyone in right wing media, is now admitting that this Supreme Court decision, did NOTHING to stop Trump from imposing tariffs.
Why?
Because Trump ALREADY has several other legal means to impose tariffs on whoever he wants to.
And these other laws, are approved by Congress and have ALREADY been litigated many times in the past.
But people won’t ask the right questions.
Trump has the legal authority to impose tariffs and will continue to do so.
But here’s the real question that nobody is asking:
With all the legal options available to Trump, to impose tariffs, that have ALREADY been proven to be legal under the Constitution….WHY did Trump choose the IEEPA law, to impose some of his tariffs?
Trump is a genius and surrounded by brilliant legal minds.
He’s clearly done his homework on legal precedents, which is why he keeps winning Supreme Court decisions.
So WHY use the IEEPA law, knowing that there was a high probability that he would lose, given the fact that the IEEPA law, isn’t focused on tariffs, but rather SANCTIONS?
