Feb 9 — PAS described today as “Black Friday” 
questioned the integrity of the Sultan of Kelantan

OSTB : Sdra Takiyuddin jangan pula mula putar alam ok. Mahkamah Persekutun tidak boleh sekali-kali pun mempersoalkan integrity Sultan Kelantan atau integriti mana-mana Raja Melayu yang lain sebab Mahkamah Persekutuan adalah mahkamah di bawah naungan DYMM Raja-Raja Melayu khususnya seorang daripada mereka yang dilantik menjadi DYMM YDP Agong Malaysia mengikut peraturan Perlembagaan Persekutuan.

Yang menjadi jelas sekarang ialah kerajaan negeri Kelantan (terutama sekali kerajaan Pas negeri Kelantan) telah mengusul, meluluskan dan melaksanakan undang-undang negeri yang bertindih dengan undang-undang Persekutuan.  

Kerajaan Pas negeri Kelantan harus meminta maaf dan ampun daripada DYMM Sultan kerana telah tidak mengenali dan mengikuti prosedur undang-undang yang betul. 

Takiyuddin, said a nationwide protest will be held to defend the royal institution.

OSTB :  What for ? Untuk apa awak nak protes di tepi jalan? Awak sudah kalah di gelanggang mahkamah, yang berdaulat di bawah naungan DYMM YDP Agong. Mahkamah yang mana ahlinya terdiri daripada para hakim Yang Ariff dan senior belaka yang terpelajar dan sangat fahami undang-undang dan Perlembagaan Persekutuan.
 
Sekarang awak sudah kalah di mahkamah tetapi awak nak mengganas di tepi jalan pula. Kenapa nak tunjuk perangai jalanan pula? 
 
Bila orang terjun ke dalam sungai untuk bunuh diri awak buat sembahyang hajat atas jambatan itu.  Sekarang bila hilang kes di Mahkamah, kenapa tidak buat sembahyang hajat di kompleks Mahkamah Syariah Kota Baru? Lebih baik buat sembahyang hajat di kompleks Mahkamah Syariah Kota Baru saja.
 
Black Friday as decision was against Islamic Shariah law. When one Shariah law in one state is cancelled, it also affects the same laws in other states, 14 more states, are in a very dangerous and critical situation.

OSTB :   Very dangerous and critical situation kepala hotak apa Takiyuddin? Negara kita sudah pun mempunyai sistem perundangan yang baik. Mahkamah Syariah pun masih berjalan lancar di semua negeri. Cuma kita tidak perlu ada dua sistem perundangan jenayah yang bertindih. Apabila kesalahan itu sudah ada penyelesaiannya ikut undang-undang Persekutuan maksudnya kita tak payah lah bayar gaji dua kali untuk hakim mahkamah syariah, peguambela, pendakwaraya, bayar dua kali gaji pegawai penguatkuasa dan pegawai mahkamah. Bayar dua kali untuk sewa ruang pejabat, api dan air kompleks mahkamah. Asalkan jenayah itu menerima hukumannya dan keadilan undang-undang terjamin satu sistem mahkamah lebih bagus daripada dua sistem mahkamah yang bertindih.

OSTB : Kau jangan buat-buat onar kononnya nak mempertahankan 'the institution of the Ruler'.  As I said the Pas State gomen should apologise to the Kelantan Ruler for having passed and implemented laws without checking if they were ultra vires the Federal Constitution. Kalaulah kerajaan Pas di Kelantan buat kerja dengan betul then this issue would not have happened. Ini adalah kesalahan kerajaan negeri Pas di Kelantan. You must apologise to the DYMM Sultan.



“Originally, 20 Sections in this enactment listed as invalid and void because the Kelantan State Assembly has no authority to make this law. However, when the state assembly passes this law, the enactment must be approved by the Sultan of Kelantan. So the meaning of this law has been approved by the Sultan of Kelantan.

“The Shariah court in Kelantan is big and beautiful, but the law is annulled, that’s the situation we need to understand as Malaysians, especially Kelantanese, have a reason for Sharia criminal law. This is state law,” he added.

In Kelantan, the Sultan is the head of the Islamic religion which includes passing Shariah provisions in the state.

Takiyuddin said Opposition MPs will raise this controversial issue in the Dewan Rakyat when it reconvenes end of this month.

“I understand that many members of our Parliament will raise questions related to challenges to Shariah law in the states and we know that at the federal level, there is a committee called the National Islamic Affairs Council, which is chaired by His Majesty the Sultan of Selangor. So we will also ask in Parliament what is the result of this committee. What have they done to protect the position of shariah law,” he said.

Earlier, the Federal Court has today struck down 16 out of 18 provisions under the Kelantan Shariah criminal enactment as unconstitutional, ruling that the Kelantan State Legislature does not have the power to enact laws on said offences because there are federal laws covering the same.

Chief Justice Tun Tengku Maimun Tuan Mat, who is leading a nine-member panel of judges, delivered the majority verdict of 8-1 in the constitutional challenge filed by two Muslim women.

Chief Judge of Sabah and Sarawak Tan Sri Abdul Rahman Sebli was the only judge who dissented or disagreed with the majority.

Nik Elin Zurina Nik Abdul Rashid, a native of Kelantan, along with her daughter Tengku Yasmin Nastasha Abdul Rahman, filed a petition directly with the Federal Court under Article 4(4) of the Federal Constitution, naming the Kelantan government as the sole respondent in this case.

The duo are challenging the constitutionality and validity of 18 provisions under the Kelantan Syariah Criminal Code (l) Enactment 2019, claiming that the Kelantan State Legislature does not have the power to enact laws on these offences because there are federal laws covering the same.

Through the court challenge, the two women are seeking the Federal Court to declare that 18 provisions of Kelantan’s Shariah Criminal Code (I) Enactment 2019 are invalid, arguing that the Kelantan state legislative assembly had overstepped its powers or had no powers to make such laws.



Chief Justice ruled 16 of 18 Kelantan criminal enactments unconstitutional

The 16 unconstitutional provisions are:
- Section 11: Destroying or defiling a place of worship - Unconstitutional
- Section 14: Sodomy - Unconstitutional
- Section 16: Sexual intercourse with a corpse
- Section 17: Sexual intercourse with a non-human
- Section 31: Sexual harassment
- Section 34: Possessing false document, giving false evidence, information or statement
- Section 37: Gambling
- Section 39: Reducing scales, measurements and weights
- Section 40: Executing transactions contrary to 'hukum syarak' (syariah law)
- Section 41: Executing transactions via usury
- Section 42: Abuse of halal label and connotation
- Section 43: Offering or providing vice services
- Section 44: Preparatory act of offering or providing vice services - Unconstitutional
- Section 45: Preparator act of vice
- Section 47: Act of incest
- Section 48: Muncikari (person who acts as a procurer between a female and a male for the purpose which is contrary to hukum syarak).
