PETALING JAYA: A constitutional lawyer disagrees with law minister Takiyuddin Hassan’s view that the Yang di-Pertuan Agong did not specify when Parliament should reconvene.
Bastian Pius Vendargon said Takiyuddin may have taken the King’s statement literally.
“One needs to read the two statements in their entirety and holistically and to look at the spirit and intent of the advice, and caution by the King,” he told FMT, referring to the statements by the King and the Malay Rulers, who met yesterday.
“It is clear that ‘as soon as possible’ means the government should act now and not procrastinate.
“The Malay rulers also said there is no need for an emergency. All these suggest that Parliament should reconvene without any delay.”
Furthermore, Vendargon said, the King had also stated in February that Parliament could sit during the emergency.
He said one should read the statements issued by the palace in their “spirit and intent, and not literally.”
Vendargon said the “pointers” in both statements are clear as they touch on the urgent matter of the Covid-19 situation, vaccination, the need to practise democracy and for Parliament to discuss these issues.
He said the country will face a constitutional crisis if the government fails to follow the advice of the palace to reconvene Parliament as soon as possible.
Yesterday, Takiyuddin said the King did not set a date on when Parliament should reconvene.
“If the King wants us to hold a parliamentary sitting, we will, although we are still facing a pandemic,” he said, adding that a normal sitting involves at least 1,000 individuals, including the MPs and their aides.
In a statement following the meeting of the Malay Rulers yesterday, Comptroller of the Royal Household Ahmad Fadil Shamsuddin said the King was aware of Parliament’s important role in discussing issues linked to Covid-19.
Fadil said the King took this stand after being briefed by the special emergency committee and experts, adding that reconvening Parliament would allow for the emergency ordinances and national recovery plan to be debated by MPs.
