Explain DNAA in maid’s murder case, Najib tells Tommy Thomas
Najib Razak said as attorney-general when the case was first prosecuted, Tommy Thomas had not given any reason for the DNAA request.
PETALING JAYA: Najib Razak has urged former attorney-general (AG) Tommy Thomas to explain why he requested that a woman who allegedly murdered an Indonesian maid be given a discharge not amounting to an acquittal (DNAA) four years ago.
This comes after the Federal Court, on Thursday, upheld the acquittal of senior citizen S Ambika who had been charged with murdering Adelina Lisao, 28, at her home in Medan Kota Permai 2, Bukit Mertajam, on Feb 10, 2018.
On April 18, 2019, the High Court in George Town acquitted the 62-year-old woman after the prosecution had requested for the DNAA.
Najib said the Federal Court had in its ruling said that the prosecution had not given its reason at the High Court when it requested for the DNAA.
The former prime minister said this was surprising and pointed out that the Pakatan Harapan (PH) appointee was the AG when the request was made.
“It is therefore only appropriate that Thomas explains why the charges were withdrawn without justification as he was serving as AG at the material time.
“The citizens of Indonesia are disappointed and angry with the acquittal as it appears justice does not exist in Malaysia,” Najib said on Facebook.
Last year the Court of Appeal affirmed Ambika’s acquittal.
On Thursday, a three-member bench chaired by judge Vernon Ong said trial judge Akhtar Tahir had exercised his discretion to give Ambika an acquittal. He said there was “no appealable error” by the High Court and the Court of Appeal when dismissing the prosecution’s appeal.
Indonesian ambassador to Malaysia Hermono said his government was disappointed but accepted the decision, adding that they would look into other possibilities like filing a civil suit.
Najib said with the acquittal, no one would ever be held responsible for the death of Lisao.
“Many are upset and don’t understand why this has happened,” he said.
