Court orders Nigerian man Simon Momoh freed, after 39 days in ‘unlawful, unconstitutional’ detention apart from Malaysian family

SHAH ALAM, April 23 — The High Court today ordered for Nigerian man Simon Adavize Momoh to be released, which means he would be able to be reunited with his Malaysian wife and their two young Malaysian children soon.
High Court judge Datuk Ab Karim Ab Rahman ordered for the release to be done as soon as practical, after having found that Simon was detained unlawfully and unconstitutionally.
Simon has spent the past 39 days since March 15 in detention.
On April 1, Simon had filed his habeas corpus application, naming the Malaysian Prisons Department, the Immigration Department of Malaysia and the Home Ministry as the three respondents.

Malaysia is fast becoming like a Communist country where people who run afoul of the authorities "disappear" , sometimes never to be seen again.
ReplyDeleteSimon Momoh is fortunate that all the time , there were people who continuously fought for him, and the sheer volume of publicity would have shamed the authorities if they acted gratiuitously.
He's not out of the woods yet.
Habeas Corpus is a Court order for the relevant authorities to produce a person who may be unjustly detained, It is a very old principle of English Law, which Malaysia fortunately still retains.
There is still the separate matter of his immigration visa status.
The Home Affairs Minister has absolute discretion , not subject to Court review , to cancel a foreigner's permit to remain in Malaysia, and put him on the next plane out.
