PUTRAJAYA: The Federal Court today dismissed an appeal by 16 former Umno members who want Umno dissolved for not holding party elections, because the party’s Supreme Council had already held the elections.
A five-member bench chaired by Chief Judge of Malaya Azahar Mohamed said the appeal was now academic as the party had conducted its elections at all levels.
Furthermore, he said, the 16 had no locus standi to bring the matter to court as they were no longer members of the party.
“In the circumstances, based on academic grounds, there is no necessity to answer the two leave questions posed,” said Azahar.

Eh...I thought they are no longer members of UMNO because they were sacked for taking legal action against UMNO...? So anytime anyone sues his party, just sack him, then his case will be thrown out because he has no locus standi....? Circular logic...only judges can understand....

Umno Seri Merpati Pandan Indah’s then branch leader, Salihudin Ahmad Khalid, and 15 fellow members had sought leave for judicial review against RoS and Umno in 2018 on grounds the party had breached its constitution by delaying its elections.
Their membership was terminated on April 21, 2018 for going to court.

Umno secretary-general Tengku Adnan Tengku Mansor said membership of the 16 had been automatically terminated in accordance with Article 20.7 of the party’s constitution for bringing the party’s issues to court.
“I have discussed with the lawyers yesterday and I will issue letters of termination for these 16 people. I know what is happening. This is another game by the opposition,” said Mr Tengku Adnan, who was speaking to reporters after the launch of a groundbreaking multi-level parking building ceremony on Saturday.

Delete1) If they were still members at the time the Party Elections were held, then they should have locus standi.
Else any organisation can gratuitously fire or force people out after the fact, and they get away with it.
2) That UMNO subsequently held elections should not retrospectively make things OK. If UMNO was illegal at that point, it was illegal.
Else any organisation can get away with illegal behaviour by subsequently correcting it.
That's why the judgement doesn't look good to me.
