DAP Aziz Bari: Speaker's arguments lack consistency and direction

Dewan Rakyat speaker Azhar Azizan Harun's arguments against a vote of confidence in the Lower House lacks consistency and direction, a Perak assemblyperson said.

Tebing Tinggi state lawmaker Abdul Aziz Bari (above) said this in response to Azhar saying that confidence can be proven outside of Parliament.

Earlier, Azhar was pressed on a vote of confidence, with Jelutong MP RSN Rayer citing the ousting of Bersatu's Ahmad Faizal Azumu as Perak menteri besar through that process last week.

Azhar said he was not bound by other speakers' rulings, and insisted he had no power to fast track the motion.

Instead, he said legal precedent dictates that confidence can be proven outside of Parliament.

"Of course, it’s true that Azhar is not bound to follow the decision of other speakers. But he’s not bound to follow the court either," Aziz told Malaysiakini.

"He seems to tell us he’s bound by the court decisions on the matter. His arguments lack consistency and direction," he added.

BN had staged a coup in Perak in February 2009 when three Pakatan Rakyat state lawmakers declared themselves as independents.

The trio then supported BN to form the Perak state government, which led to a series of court battles between former PAS menteri besar Nizar Jamaluddin and Umno's Zambry Abdul Kadir.

Ultimately, the Federal Court in February 2010 declared Zambry as the lawful menteri besar.

'A House vote remains the most democratic way'

This ruling was upheld when BN tried to challenge Warisan's takeover of Sabah through defections shortly after the 2018 general election.

Aziz, who took part in last week's vote against Faizal in the Perak State Legislature, said a House vote remains the most democratic way.

"It’s open, transparent, and above all, democratic as it’s difficult to manipulate. What happened in Perak last week has shown us that," he said.



The DAP assemblyperson also rubbished Azhar's insistence that he could not fast track a vote of confidence motion on his own.

"The Dewan Rakyat Speaker has absolute power to decide on the matter.

"And he has the final say over the interpretation of Standing Orders, however absurd it is," he said.

Azhar's argument is that government business takes precedence over motions from private members.

Therefore, he said, those pushing for the vote should urge a minister to push it forward.

Meanwhile, Pasir Gudang MP Hassan Karim has submitted to a question for Minister's Question Time - asking when one of the 25 motions of no confidence or two confidence motions would be debated in the Lower House.

The next Minister's Question Time will be held on Thursday.
