Partial emergency best way for Muhyiddin to stay on as PM, says analyst

PETALING JAYA: A political analyst says the declaration of a partial emergency would be the best way for Prime Minister Muhyiddin Yassin to remain in the top post while fending off pressure to step down.
Awang Azman Pawi of Universiti Malaya, said Muhyiddin would be able to avoid any no-confidence motion in the Dewan Rakyat and also the tabling of the Budget 2021, which would lead to the fall of the government if it fails to be passed in Parliament.
“In my opinion, the Covid-19 situation in Malaysia is only ranked 88th in the world, which means it’s more controlled when compared with other more developed countries, such as the United Kingdom, Holland, Canada and the US.
“It’s obvious that Covid-19 is being used by Muhyiddin to remain in power and to avoid being embarrassed by his political enemies,” he told FMT, adding that this emergency could last up to six months.

Awang Azman said the purpose of this partial emergency was to bring political stability and allow Putrajaya to focus on managing the pandemic as well as the nation’s economic recovery.
“When the situation clears up, then a general election can be held,” he said, adding that the King would be expected to appoint a new Cabinet for the emergency.
He said this move would allow the government’s spending to be done without needing to be approved by Parliament, while also avoiding any no-confidence motion.
This came following speculation that the Perikatan Nasional government may seek a declaration of emergency as Covid-19 cases hover around 700 to 800 daily.

KUALA LUMPUR, Oct 24 — Several lawyers polled by Malay Mail have cast doubts over the feasibility of the rumoured so-called “partial emergency” dubbed either a political, economic or health emergency, following speculation yesterday that the government is seeking such powers.
Pointing to the Federal Constitution, the constitutional experts said the country’s supreme document only provides for one type of emergency that would either cover the whole country or any state in its Article 150.
“There is no such term as an economic emergency. It’s either a nationwide emergency or a state-specific emergency,” Bar Council’s constitutional law committee deputy chair Lim Wei Jiet told Malay Mail.
His view was echoed by lawyer Surendra Ananth, who said there is only one type of emergency which is a proclamation by the Yang di-Pertuan Agong under Article 150(1).
Meanwhile, lawyer Syahredzan Johan questioned on Twitter last night over the origin of the term, highlighting that no such concept exists in the Constitution.
“There is no such term as political emergency in the Federal Constitution. An emergency is an emergency and to declare for an emergency there needs to be safety, economic and public security threat.
“There is no mention of political conflict in a state of emergency. There is no political emergency in the Federal Constitution,” he wrote.

It is a set of circumstances, not of fact alone, but of ‘fact and law’.

If the proposed emergency is approved, this could be a move by the government to eliminate the risk of Budget 2021 being rejected in Parliament. The budget is much-anticipated by economists and the rakyat, considering the need to further support economic activities that have been affected by the coronavirus-induced crisis.
The Perikatan Nasional (PN) government’s rumoured plan to announce a state of emergency ahead of Budget 2021 appears to be a strategic move to avoid the budget from being defeated and to end political squabbles for the time being.
“With a state of emergency, the Parliament will no longer be in effect. The budget would be presented to the Cabinet and it can be approved without the vote from all 222 Members of Parliament (MPs), ” says a political observer.
At the time of writing, it remains unclear how the emergency would play out, pending an official announcement. Highly-placed sources say the Yang di-Pertuan Agong Al-Sultan Abdullah Ri’ayatuddin Al-Mustafa Billah Shah would have the final say as to when the state of emergency will take effect.
However, officials at Putrajaya informed The Star that only political activities will be affected by the emergency.
“It will be business as usual. Economic activities will carry on and there will be no curfews.
“In a nutshell, life goes on as we know it. This is for the good of the country in fighting Covid-19, ” a source says.

PETALING JAYA: A PKR lawmaker has challenged Cabinet members under the Perikatan Nasional-led government to resign if they disagree with the speculated move by Prime Minister Muhyiddin Yassin to declare an Emergency in the country.
Subang MP Wong Chen said this in a Facebook post last night, calling for them “to do the honourable thing and resign now.”
“If you continue to side with the prime minister, know that if an Emergency is indeed declared, your inaction and stance will contribute to the erosion of the rule of law and fundamental rights in Malaysia,” he said.
He also appealed to all MPs currently aligned with the PN government who “took a solemn oath to defend the Federal Constitution.”
“For those MPs who are non-Cabinet members you must revisit that oath now, instead of blindly supporting this Emergency path.
“It is not too late to change your stance but you must do it publicly and promptly, or your inaction will cripple Parliament, the august house that gives you your own political legitimacy,” Wong said.
He also reminded them of the legacy they will leave behind if they support the PM on this issue.
“Stand on the right side of history. Change your position now and together, a non-partisan majority of MPs can put an immediate end to this manufactured Emergency crisis.”
Wong said that there was no justification to use the surge in Covid-19 cases to declare an Emergency when an enhanced lockdown was sufficient.
