... 'Under normal circumstances, it is taken for granted that the Yang di-Pertuan Agong would not withhold his consent to a request for dissolution of parliament. His role is purely formal' - see Malaysiakini Perak turmoil: Sultan has final say.

My learned visitor Observer gave a possible explanation and most likely reason for HRH’s very unpopular decision. Observer said:

I don't like the idea of toppling an elected government through frogs one bit at all - whether it’s done by PKR or by BN.

My mateys, who include some top-class retired lawyers had a sombre round of drinks last night, and we ended up with a heavy conversation around the Constitution.

I think the Sultan, faced with the swirling political controversy, chose to focus his decision based on just two paragraphs in the Perak Constitution - the Constitution of Malaysia has similar wordings.

(a) the Ruler shall first appoint as Menteri Besar to preside over the Executive Council a member of the State Legislature who in his judgment is likely to command the confidence of the majority of the members of the Legislature; and

(b) If the Menteri Besar ceases to command the confidence of the majority of the members of the State Legislature, then, unless at his request the Ruler dissolves State Legislature, Menteri Besar shall tender his resignation and that of the Executive Council..

There you are, a very narrow focus on the constitution, setting aside any issues about frogging, whether the resulting government represents the will of the people etc. etc.

I'm afraid it’s appropriate per the Constitution.

Fair enough. Then I referred to Malaysian Insider, looking for views from Malik Imtiaz Sarwar who wrote in Perak: A constitutional crisis (relevant extracts only):

Now that the dust is settling, it is becoming clearer what it is that took place in Perak over the last 24 hours. My respectful view is that His Highness may have acted erroneously in directing the resignation of the menteri besar

… then yadda yadda (a recapitulation of the significant events) followed by yadda yadda (same as Observer’s comments) …

It must be borne in mind that:

· as noted above, Article 16(6) is specifically directed to a no-confidence scenario, that is the incumbent menteri besar can seek the dissolution of the assembly upon his having ceased to command the confidence of the majority
· Article 36(2) however provides more generally that His Highness has the power to dissolve the assembly. It is clear that this provision is aimed at allowing His Highness to dissolve the assembly for other reasons thought to be appropriate
· the Perak Constitution does not empower His Highness to dismiss the menteri besar. The manner in which the menteri besar is to be removed from office is as provided for under Article 16(6), through a refusal to dissolve the assembly at the request of the menteri besar when the menteri besar has ceased to command the confidence of the majority of the assembly.

It is apparent that His Highness had moved on the assumption that the request for dissolution was prompted by the menteri besar having ceased to command the confidence of the majority. This may have been based on a misapprehension of the situation and the appeal to the Sultan to dissolve the assembly for reasons other than confidence. If so, then the directive to resign was arguably not tenable.

Malik, being balanced and undoubtedly a nice polite bloke, used very careful ethical language to ‘suggest’ that HRH’s directive for Nizar to resign 'was arguably not tenable'!
In other words, HRH was wrong!

But more troubling was (what I thought to be unnecessarily threatening and hostile) HRH’s warning to Nizar that the MB doesn’t want to go, the posts of menteri besar and state executive councillors are considered vacant.

Wah, so fierce one!

Ok, it’s a great disappointment for everyone who thought HRH would be their silver bullet. Alas … all kena shot in their posterior liao wakakakakaka

What has been even far far more disturbing has been the nasty attempt of a pro-UMNO blogger (known to be a staunch Mahathir-ite) who has posted insinuations that MB Nizar has committed treason, though he tap-danced around by attributing the accusations to others (undoubtedly people of the same pro UMNO ilk).

What a f* under the belt low blow! It's like kicking a man already shackled and down on his back.

For this staunch Mahathir-iteIf, if he is trying to tar Nizar as Jebat, just remember what his hero, Dr Mahathir said of Hang Tuah in Malaysiakini:

Let me quote the story of Hang Tuah: Whenever the King gives an order, Hang Tuah and his brethrens would say, ‘mana titah, patih junjung’ (I will obey your bidding) [...] that is why Hang Tuah killed his friends. He was too loyal…

Even during the (first prime minister) Tunku (Abdul Rahman)’s time, I was not very loyal person. I am loyal only to what you do, not what you are. Do the wrong thing and I won’t support.

    Similarly, I would like to pay my respect to you, though with much less eloquence. Your persistent calls to avoid katak-katak at all costs and for more integrity instead of a blind support for one side of the political spectrum. I have fallen victim to such partiality, on grounds known to all.

    I hope the good people from both coalitions will listen to you and repudiate unfair moves.
    To PR, please invite Anwar to take a back-seat while you reject once and for all unethical treachery to voters. To BN, let Najib take a break as he has done enough to ensure his perception is not suitable for a supposedly PM-to-be. To both coalitions, do the job you have been elected to perform, at last. These two leaders are dragging their respective coalitions down the sea level.

  2. Speaker is given rights to remove a member of the DUN. The 3 now-independent ADUNs resigned, and the speaker of the DUN accepted their resignation.

    Hence, legally speaking, the DUN speaker removed the 3 kataks from DUN, and the 3 seats are open for by-election. Which means the DUN right now is 28 vs 28, with 3 vacant seats...

    Just because EC refuses to hold by-election doesn't mean these 3 kataks are still ADUN, unless the court void the speaker's decision, the DUN is still 28 vs 28 with 3 vacancies...

    How can the 3 kataks that are no longer ADUN go to convince the Sultan that they support BN??!!!

  3. HRH did not make an error.

    Article 16(6) points to a situation when no other person command the confidence of the majority to be MB, thus, fresh election to break the standstill.

    In this case, obviously there is another man commanding the confidence of the majority. Thus, HRH rightfully appointed that person MB.

    The ex MB should tender his resignation. In fact, that is mere formality, the moment he lost confidence of the majority, he cease to be MB. You are not MB if you don't have the majority behind you.

    On the topic of representation of the people's will.

    The constitution is seen to be inconsistent with reality. It views that people vote individuals, not party. We all know that is not true.

    So you have a situation where some feel the new state govt does not represent the will of the people. On the other hand, the constitution view that the people's will is still represented because the people voted individuals, who are free to choose which party they want be under.

    Clearly,the REAL safeguard to uphold the people's will is a law prohibiting member of assembly hopping party. Want to switch? Resign first.

    HRH n Raja Nazrin has always given good lecture on Democracy, Rule of Law, Respect for the Constitution, Good governance and in Raja Nazrin latest speech he mentioned that HRH has always "understood the sentiments and aspirants of his subjects" yada yada...

    a big let down. good in rhetoric short in deliveries.

  6. PR and the GSOS had made a major blunder by defying the HRH. First Nizar being a Malay Muslim has committed something akin to a treason and sin. This will effectively destroy his political future. And his rambling and defiant attitude ala Rafe Benitez will be taken negatively by the HRH and the Malays of Perak and the nation.

    As for PR, by organising the demo and going against Sultan's decision means losing much favour with the rulers who finally had started to warm of PR. Again, this might means the rulers will side BN in the future.

    I am certainly not in favor or katakcracy but having said that I don't even have an aota of sympathy for PR's and Anwar's lost in Perak.

    BN too by adopting such undemocratic means has lost their moral ground.

    But in terms of politics one cannot but admire Najib's political streetfighting creds which had left Anwar look like an ageing Pak Rempit /Bag Snatcher.

    Perhaps Najib is sending the GSOS a message that he will resort to dirty tricks to defend BN if need to.

    With this, one thing we can be sure. Anwar's "OX"ymoronic 916 plan is doomed (if it has not that is...). No BN ADUN or MP with half-a-brain will ever consider talking to PR in the future. On the otherhand, knowing BN's strength, PR ADUNs and MPs will hold PR and the GSOS at random for the next few years and give them endless problems. In fact I expect Selangor to descend into crisis soon.

    BTW for Perak, expect a few more ppl (probably PKR) to defect.

PR supporters are all blinded royalty to Anwar only, from which mould Anwar and his supporters come from?.............what are they good at?.............what are their aims?.............what tactic they will use?..............they are very good to blame and see others fault, but fail to see and except their own flaws. We see it all, their true colour have been reveal over and over, time over time, again and again. Now they want to find fault with HRH decision.

    To put it simple, these people are not fit to rule, that how the learned and wise HRH sees it.

    Back to history, when Tun Dr Lim Chong Eu lead Gerakan to join BN, there was a huge outcry that Tun Dr LCE betray the people, but later after seeing his action resulted to tremendous development and standard of Penang lifted many fold, the people of Penang change their viewpoint and put Gerakan into power until recently.

    Here the learned and wise HRH not necessary have to listen to the people's current sentiment, many time people perspective turn out to be wrong due to rush emotion, that why we needed learned and able leaders to direct the course. I believe HRH actions and decision is base on his wisdom and of course for the betterment of his subjects and not favouring either Anwar or Najib. Perhaps those who disagree with the HRH now will agree with him later when they see the light. It is irrational to cut him off, I trust he make a wise decision base on his good pass deeds and records.

    But do remember, how do you prove one has no longer hold confidence of the majority?

    In this case, an oral agreement with HRH? A signed letter? or?

    Do remember that a signed letter means nothing when EC, not even a court, dismissed the legal letters signed by the kataks... And oral agreement is absolutely nothing, especially when it wasn't even recorded...

    Malik Imtiaz had provided an excellent case back in 1966, where the Sarawak governor's move to sack the CM was ruled unconstitutional...

    As with most countries, judiciary system refers to precedents and conventions...

    I'm glad YB Karpal Singh finally voiced and said he will sue the Sultan and new BN government...

    Is that true that they have resign ? What about the fact that they have openly disclosed that the letter was an open dated resignation letter and that they have lodged a polis report that they have not sent any resignation to the speaker ?
    If it is true Hee has also resign why would Guan Eng plead with her to come back ?? Pls enlighten me .

    Won't be surprised HRH will decree that those not happy with his decision can leave Perak or PR aduns who keep on demonstrating against his decision will be made persona non grata in Perak .

  17. This is getting out of hand...the demonstrators not just defying but also rebelling against the HRH Sultan, which is akin to treason.

    Did you guys notice that the mob started at the mosque and shouting religious slogans and not democratic themes ? It can only mean that these guys are from PAS and the religious extremist elements of PKR.

    The more they create problems the more support they lose with the Rulers and nuetral Malaysians. Whatever sympathy they had generated had been lost. The Perak Chinese is being put off by this hysterical and religiously slanted demonstrators and would throw their lot with BN's promise of peace, calm and security.

    BTW does anyone know where is the GSOS when the country needs him ? Don't tell me it is the Turkish Embassy again. Or perhaps he is asking Obama for a few billion and the help of CIA/Mossad in order to defeat BN ?

    Chaptokam : Yes, I expect Selangor to fall soon, with that dim-witted, bumbling clown of a MB to be soon shown the door. I am sure the PKR reps are calling their UMNO counterparts to discuss about their "career prospects". I can see Khir Toyo being a busy man today. And I wouldn't be suprised to be a lot of PKR MPs hanging around at Putrajaya today...

    Just be fair to everyone the 27 UMNO Aduns were not thieves , they were duly elected by the people and rakyat of Perak . So is the lone MCA Adun who is also duly elected by the rakyat of Perak , not Hee .

    So to you all PR aduns are angels and all BN aduns are all thieves ?

  25. Have everyone forgotten that it was Perak royalty who signed the Pangkor Treaty of 1874. Everyone knows this treaty paved the way for the official colonization of the Peninsula by the British. What is selling out to UMNO compared to selling out to the British. Oh, I forgot. Umno is the successor to the British. Guess the Malayan political left wingers were right all along. Took the Malays too long to see UMNO's true colours though. Then again better late than never.

  29. Keep going strong guys and turn Perak into a burning cauldron like Pakistan or Bangladesh and drive away all investors and business, making Perakian lose jobs by thousands. And then we will see how the Chinese community responds...

    Nizar by not resigning is behaving like Rafa Benitez and is cracking up....You can argue all about technicalities of the HRH not having the right to dismiss the MB but how far can you go with your lack of majority ? This is just postponing the inevitable.

    Now the Lion of Jeluntong wants to sue the HRH. While I like the principled Singh, this is yet another harakiri attempt to burn the bridges with the royalty and make the Malays even angrier.

    I can bet that UMNO leaders' and Najib's handphones' are ringing nonstop with PR rats jumping the sinking KD Deformasi by now. For all we know, Nizar, Ngeh and Nga would be the only 3 of the 28 remaining PR members by the end of the week.

    And Khir Toyo must be busy attending meetings with PKR ADUNs and also PAS' rebel faction. More than Perak, Selangor is one big and seriously dysfunctional PR family. It wouldn't long before we see the bumbling clown Khalid dragged out in tears of the Shah Alam PKNS complex by the police.

    If it were just another HRH we can give him the benefit of the doubt. But not one who was once Lord President of our Courts. He has access to an entire country of legal experts to decide on the right course of action, and FAILED!!

    In the end, it is the PEOPLE who should decide and the only course of action open to HRH where the picture was not cut and dry was to call for fresh elections.

    That he failed is a sign of the pathetic state of affairs in our nation that has been reduce to a banana republic by 50 years of BN/UMNO rule!!

Even Teng Chang Kim accused CS of being a BN stooge . Who knows in politics the accuser could turn out to be the first one to leave and jump ship .
    How about Loh Kua Burne , the movie director of korek , korek , korek ? Been pretty low profile and was once punched in the face by one of his peers clergy boy ? Imagine even his PAS guy don't even respect the PKR guy !! Oops shouldn't have disclosed so much info here least they'll be under 24 hrs watch .

    Let them repeat what UMNO did in Kuala Trengganu just after the March elections . UMNO was so arrogant that during the dispute in the appointment of the Menteri Besar between Jusoh and Ahmad Said they put up banners calling DYMM Agong NATANG .
    Today they are repeating what UMNO did and hope this will be on the posters come GE . UMNO arrogance is today PR's arrogance .

  36. PENANG, Feb 6 (Bernama) -- DAP secretary-general Lim Guan Eng challenged the Barisan Nasional (BN) to hold a snap election in Perak to show who commands the majority in the state.

    Lim, who is also Penang Chief Minister, said power should be given to the people to elect a government that would lead Perak as was the case in the general election in 2008.

    "We leave it to the people to determine everything. As it is, it appears that we are watching a movie where manipulation has led to a transfer of power which is not valid in terms of the law," he told reporters at his office, here today.

    He said this when asked to comment on a statement by Education Minister and Umno Youth head Datuk Seri Hishammuddin Tun Hussein who was confident that the transfer of power in Perak could spread to three other states which were still ruled by the Pakatan Rakyat (PR) coalition namely Kedah, Selangor and Penang.

    "Hold a fresh election and we will see whether he could wrest the state or otherwise. If he is truly a gentleman, I urge him to dissolve the Perak State Assembly and we fight it out in Perak," he said.

    Lim described the BN government formed in Perak now as invalid as it did not get the full mandate of the people.

    "The PR has 54 per cent support while the BN has 46 per cent. Which democracy states that the minority can rule the majority," he pointed out.

    WHAT THE HECK THIS FELLOW CONTRADICT HIMSELF AGAIN, WHY HE DID NOT SAY THIS ON 916 SITUATION, IN FACT HE SUPPORTED ANWAR INTENTION OF LURING BN LAW MAKER TO JUMP SHIP, DIDN'T HE PLAYED A BIG PART ON THE NO CONFIDENT VOTE AGAINST AAB.     Well said . He is CHEAP MINISTER OF PENANG . Also now Perak is in a mess , Penang will be on auto pilot as he will be busy with Perak . Wonder where his priorities is right now , Penang ? Perak ? or Parliament ? This is the problem with a guy who wears so many hats .
    Still talking as an opposition leader even though he is Cheap Minister of Penang .

    Why don't you dissolve the Penang govt and see whether you can still win back all the seats in Penang ? Nothing less than five seats currently held by PKR and DAP will be gone ! back to BN .

    If TDM of which I have no strong liking for , is still PM instead of Pak Lah during the last GE , sorry to say , you'll all be in Kamunting today , and you still think you will be Cheap Minister today ! ? Ought to thank your lucky stars its Pak Lah who is PM .

    Spot on about the Cheap Minister....I used to admire and like him...until he became the Cheap Minister of Penang when he started to show his true colour.

    He is a walking disaster and the damage that he is causing to Penang is incalculable. If he is going to continue as the CM, then Penang is doomed.

    His DCMs are even worse.I can share some inside info about these clowns. DCM1 Firdaus is a walking and taking timebomb that has no respect even among his party not to mention the Malays or Penangites. DCM2 Rama is even worse. He has no friends or allies even among Penang DAP with the Indian members have completely boycotted him. The other Indian PKR members are eyeing the DCM post and plotting to get rid of him. He shocked many people by his work ethics by saying that he won't attend any functions during the weekend.

    PS : As for the Camry 2...actually I heard rumours that some brand new Camry's with Perak plates (single digit some more) will be sold dirt cheap soon...But I would rather pass the one that a certain ex-defacto MB used, if you know what I mean..wink wink...

    Won't be surprised you can get it dirt cheap as its bad luck for anyone using it ...you know ..That certain ex-defacto MB used it and it brought his downfall . Chinese used to say sui meaning bad luck . Hahahaha

    Well back to Penang
    Besides the two you mentioned , there's the one who is always training for the Le Tour Le Langkawi , his training more important and until today I don't know what he has done for Penang . Perhapshe should change his bicycle for a tri-shaw to promote tourism for Penang . Then there are the other two Koays one representing Pulau Tikus and the other Sungai Pinang , again best not to disclose their bad habits , keep for the next GE . Oh yes I nearly forgot to mention this one , got lots of skeletons in the closet , greatly dislike by many . He's a lawyer , drives around in a BMW but hardly see him in his constituency . Goes by his Christian name of James . We have already named six . The rest we'll leave it later .

    Maybe Indonesia should invade the fake country called Malaysia, throw out the government and corrupted system including the monarchy, and call it the straits settlements of various races and religions from all over the world, especially Asia.

    We would be more developed, diverse, strong and cosmo compared to Australia if the British had done a HK on us.

    The current system, rules, constitution and rukun negara were just put in place by UMNO to prolong their (fake and manipulative concept of) Malay Elite dominance, which is in actuality only for UMNOputra dominance; and to allow their divide and conquer tactics and methods to fester and disunite.

    Ketuanan UMNO boleh! People deserve the government they get! Time for the people to rise and rebel!
