KOTA BHARU, Oct 31 — The Attorney-General’s Chambers (AGC) did not interfere in the decision to return former Border Control and Protection Agency (AKPS) director-general Datuk Seri Mohd Shuhaily Mohd Zain to the Royal Malaysian Police (PDRM).

Attorney-General Tan Sri Mohd Dusuki Mokhtar said his office was only responsible for providing legal advice but the issue regarding Mohd Shuhaily was an administrative matter for the ministry.

“We have not given an official opinion because it has not been referred to AGC, it is just an administrative action by KDN (Home Ministry), so we will not interfere in that.

“Whether Datuk Mohd Shuhaily wants to stay there or be transferred back to the PDRM, we will not interfere... that is more of an administrative matter,” he told reporters after the Opening Ceremony of the Handover of the Kampung Angkat MADANI (KAM) AGC 2026 Recreational Infrastructure at Taman Pinggiran Warisan, Kampung Kok Lanas here today.

On Thursday, Home Minister Datuk Seri Saifuddin Nasution Ismail said Mohd Shuhaily returned to duty with the Royal Malaysia Police (PDRM) after a decision was made last week.

Earlier, former policeman, Saifuddin Abdul Kader, requested the Attorney General’s intervention so that the investigation into his beating by Mohd Shuhaily in 2015, could be reopened.

Lawyers representing Saifuddin, Kamal Hisham Ja’afar and Muhammad Nor Tamrin reportedly said that their client lodged a police report against Mohd Shuhaily on November 19, 2015 when he was serving as the Hilir Perak district police chief.

Meanwhile, in the development regarding the separation of the roles of the Public Prosecutor and the Attorney General, Mohd Dusuki said that his party is drafting a provision regarding the method of selecting the candidate.

Previously, Minister in the Prime Minister’s Department (Law and Institutional Reform), Datuk Seri Azalina Othman Said gave the Attorney General’s Chambers (AGC) two weeks to provide detailed feedback on the proposal to separate the roles of the Public Prosecutor and the Attorney General.

He said that the Parliamentary Special Select Committee (PSSC) would meet again after receiving views on the matter. — Bernama
