

Zuhdi claims PAS 'dishonestly' added rule punishing rogue reps

Former PAS central committee member Zuhdi Marsuki has questioned the amendments in the party’s constitution, especially regarding the forfeiting of membership of rogue representatives and the legitimacy of the party’s spiritual leader.
Zuhdi described Clause 15A of the party’s constitution as being amended via “ambush” at the party’s general assembly in September 2024, and that it had been done in a “negligent and dishonest” manner.
"The draft amendment was not brought for in-depth discussion within the syura ulama council. The draft was only presented in a meeting with the syura ulama council online.
"Because of that, it is believed that it was not done according to the customs of the council as had been previously done before," he said in a Facebook post yesterday.
Clause 15A of the party’s constitution addresses matters regarding PAS assemblypersons or MPs who defy party instructions.
It states that those who go against the party would have ceased their membership.
The clause is meant to plug a loophole in anti-hopping laws where elected representatives sacked by their parties get to keep their seats.
The clause - which other parties including Umno and DAP had previously implemented - is meant to trigger an anti-hopping rule vacating the seats of representatives who “resign” from their party.

PAS recently used the clause to vacate the seats of three assemblypersons in Perlis who had sided with Bersatu during a power struggle.
PAS’ internal constitution matters have gained recent attention due to the party’s PAS spiritual leader, Hashim Jasin’s recent claims that the expulsion of the three Perlis assemblypersons is “not yet final”.
Done by ‘ambush’
Zuhdi further claimed that the amendments to the clause had been done “via ambush” because it had been presented to the assembly only shortly before approaching Maghrib (sunset) prayers.
This timing, he said, meant that the delegates present at the 2024 party muktamar in Temerloh, Pahang, were not able to give their full focus.
"I myself, who was in the assembly hall at the time, hoped the amendment would not require a long debate," he said.
He also described the clause as containing a “major loophole”, reminding that the PAS Disciplinary Committee, the PAS Central Working Committee, and the syura ulama council can impose disciplinary action.
"The council has the power to impose disciplinary action because the council also has the power to pardon an offence.
"Among these three bodies, the decisions of the Disciplinary Committee and the PAS Central Working Committee are not final. As mentioned in Clause 77, only the decision of the syura ulama council is final," he said.

Recently, Zuhdi has become increasingly critical of the party’s direction, especially following the December 2025 “Perlis crisis” where Bersatu had manoeuvred to overturn PAS leaders in the state and install a new menteri besar.
He had also been openly critical of PAS' desired plans to lead the Perikatan Nasional coalition and replace Bersatu president Muhyiddin Yassin as PN chairperson, following his resignation on Dec 30 last year.
Separately, Zuhdi’s views were also backed by Sungai Buloh PAS chief Zaharudin Muhammad, who is also the son-in-law of party president Abdul Hadi Awang.
Hadi had also been a former member of the party's syura ulama council, playing a major role in their internal crisis, which peaked in 2015.
Accusations ‘deeply offensive to PAS leaders’
PAS assistant secretary-general Syahir Sulaiman later described Zuhdi’s remarks as inaccurate and “deeply offensive”.
When contacted by Malaysiakini, the Bachok MP said that it was highly inappropriate for Zuhdi to openly criticise the party’s internal operations, especially regarding matters such as constitutional amendments.

"Accusing the constitutional amendment to Clause 15A of being done in a 'negligent and dishonest' manner is deeply offensive to PAS leaders and party members who want party discipline to be maintained.
"In fact, the amendment process was very orderly and met the requirements of the constitution and registrar of societies regulations,” he said.
"My advice to Zuhdi is: enough writing openly about internal party matters on Facebook. The grassroots members are uncomfortable," he added.
Syahir also said that if Zuhdi has any views regarding the party, they should be channelled through usrah sessions, meetings, or conveyed directly to any central PAS leader.
"I myself am always open to receiving corrections, ideas, and criticism. I’m just a phone call away," he said.
