PAS man wonders if whipping will deter environmental crimes

PAS environmental and climate change bureau chief Mohd Zuhdi Marsuki believes that the amendments to the Environmental Quality Act 1974 (Act 127) have failed to serve as a deterrent.

According to him, the amendments, which allowed for a fine of up to RM10 million to be imposed and a jail term of five years, should have a chilling effect.

However, he said the latest pollution incident in Sungai Kuang, Selangor, appeared to suggest otherwise.

“Therefore, should the Environmental Quality Act be amended again, to include whipping (as part of the punishment)?” Zuhdi (above) questioned, according to Harakah.

In 2022, the Dewan Rakyat greenlit the move to make amendments to 28 sections of Act 127 which include, among others, the enhancement of penalties with a minimum fine range of not less than RM5,000, a maximum fine not exceeding RM10 million, and mandatory imprisonment not exceeding five years.

Other laws

Selangor Health and Environment Committee chairperson Jamaliah Jamaluddin clarified that those behind the recent water pollution case can be slapped with a five-year prison term and a fine of up to RM10 million.

She was responding to reports that those responsible for the Sungai Kuang incident were only fined RM1,000 and their business licence suspended for seven days.

"The RM1,000 fine and suspension of the business licence are just based on the local authority's by-law.

"There are other laws that will come into play once the investigation papers are ready," Jamaliah was reported as stating.

On the same note, Jamaliah said the Selangor Water Management Board (Luas) is also investigating the matter under Section 79(1) of the Luas Enactment 1999.

Those responsible can face a fine ranging from RM200,000 up to a maximum of RM1 million and a mandatory jail term not exceeding three years.
