Bar Council silent about Najib's travel ban

FMT - Gerakan demands reasons for Najib travel ban:


PETALING JAYA: A Gerakan member has questioned the legal basis for the federal government’s action in imposing a travel ban on ousted prime minister Najib Razak.

Andy Yong, deputy head of Gerakan Youth, said: “It is untenable for the prime minister or immigration authorities to restrict an individual’s right to travel without giving any written reason.”

Yesterday, newly-appointed Prime Minister Dr Mahathir Mohamad said he had given instructions to prevent Najib from travelling abroad. Najib was stopped hours before he was to go on “a short break” to be with his family after a bitterly-fought general election campaign.

Yong also questioned the silence of organisations such as the Bar Council and Bersih, who had previously protested against travel bans as a violation of the Federal Constitution.

“Why are they so quiet now? Didn’t our new prime minister say the need for rule of law must be followed?” he said.

He also cited a Federal Court decision by Justice Gopal Sri Ram in 2009, in which he said the judge had held that “personal liberty” included the right to travel abroad.

He said: “Failure to provide a reason for barring travel would imply that none exists and give rise to the perception of abuse of power.


Indeed, why is the Bar Council bagitu diam?

Andy Yong may be from the despised Gerakan but in spite of that, he has more principles than the Bar Council and a whole lot of hypocrites in Pakatan.

He has balls lah.

    3. 8 countries have already implicated MO1. Everybody knows who the hell is that MO1 . We only want the billions of money back and for the criminal/s not to disappear to countries not having extradition agreement. No time to waste getting paper works...it was in the nick of time that the people are able to stop this couple from fleeing...if not for someone sending the flight manifest to Malaysiakini. It is reasonable for him and wifey to stay put in great comfort in their multi million home while awaiting for the new government to start a full scale investigation, starting with the unsealing of the OSA-ed AG report.

  5. The difference is this person is named in a US DOJ investigation involving hundreds of millions of dollars of missing Malaysian money or is Andy denying Najib is MO1. He is named in the investigation so he is not under arrest, just not allowed to leave. If we can deny PTPTN defaulters, some defaulters of a few thousand with good reason freedom to travel abroad why not someone who may be of help in recovering much much more. Or is Andy willing to guarantee his return?

  6. I support Pakatan amend the Immigration Act so that the Government needs to go before a Magistrate , at a minimum, with probable cause, to get an order to bar a person from leaving the country and the person has right of legal representation to oppose it.
    But the law is what it is right now..
    .Najib can hardly complaint.

    I just reminded my area MP on his Whatsap last night ( he is busy in KL supporting the Administration transition. ) that Pakatan holds the majority in Parliament now.

    Unjust laws need to be repealed or amended.

  7. When BN was in power I supported BN amend the Immigration Act so that the Government needs to go before a Magistrate , at a minimum, with probable cause, to get an order to bar a person from leaving the country and the person has right of legal representation to oppose it.
    But the law is what it is right now..
    .Mahathir can hardly complaint.

    I previously reminded my then BN area MP on his Whatsap not too long ago ( he was busy defending the GST ) that BN held the majority in Parliament at the time.

      So must quickly find excuses to release the carried load. Otherwise, the ball carrier would be crushed by the balls!
