A Malaysian court convicted a prominent opposition lawmaker Thursday of biting a policeman at an illegal protest — a verdict that could cause him to lose his Parliament seat.

Tian Chua was found guilty in the Kuala Lumpur Magistrate’s Court on charges of hurting a policeman who tried to stop him from entering Parliament in December 2007 to protest a constitutional amendment.

Chua, a longtime ally of top opposition leader Anwar Ibrahim, faces a maximum penalty of three years in prison and a fine. The court was expected to sentence him later Thursday.

Legislators who are jailed for a year or fined more than 2,000 ringgit ($600) must vacate their Parliament seat.

Chua, a member of the People’s Justice Party led by Anwar, has denied biting the policeman.

“They fabricate this story,” Chua told reporters Thursday, calling the charge “ridiculous.”

Magistrate’s Court Judge Faizi Che Abu ruled that Chua’s testimony had inconsistencies and was not credible.

Now, he has been publicly called a LIAR by Lim Guan Eng for saying that DAP had agreed to PAS implementing hudud in Kelantan and Terengganu - see TMI's Guan Eng calls Tian Chua ‘irresponsible, unethical’ for lying over hudud issue.

TMI reported Lim GE saying: ... DAP leaders were shocked when Tian Chua declared in Chinese newspapers that implementing hudud laws in Kelantan and Terengganu is PR policy because it was agreed to by PR and DAP.

"Tian Chua’s lies were given wide coverage in the mainstream media despite it not being supported by facts or documentation.

"I have personally spoken to opposition leader Datuk Seri Anwar Ibrahim conveying the DAP top leadership’s anger at the lies spread by Tian Chua," he said in a statement today.

Anwar had reaffirmed in both his private conversation with me and public statements yesterday that DAP had consistently opposed the implementation of hudud laws on Muslims in Kelantan, he said.

"DAP leaders hope that Tian Chua will stop repeating such lies in view of Anwar publicly reaffirming that DAP had never agreed to the implementation of hudud laws by PAS anywhere," he said.

More interesting would be WHY Tian Chua has lied on the matter?

Aha, he did so in Chinese newspapers' reports?

I suspect he might have wanted to sabo DAP kau kau in the eyes of the Chinese, wakakaka.

Look, there's no love lost between the PKR Chinese faction headed by Tian Chua and DAP for the reason that the PKR Chinese lust after DAP's blue ribbon seats, wakakaka.

The truth about PKR (if we leave out the PRM component) is that it has been KeADILan has been UMNO. It undeniably possesses UMNO genes and characteristics though it claims to be multi-racial, a claim somewhat discredited by Anwar Ibrahim's poor treatment of many of its erstwhile Indian members who left in droves - now, if they hadn't, would Azmin Ali have a chance of becoming party deputy president?


Even Saifuddin Nasution, current candidate for the PKR deputy president post, has very recently confessed that PKR is principally a Malay party, ... and if I may add, with some sprinkling of Chinese and Indian coriander (Bahasa 'penjilang', Penang Hokkien 'uan suoi', Canto 'yimsai') on the PKR soup kambing, wakakaka.

So what has that got to do with Tian Chua?

Now, while the ex-UMNO members represent the power core of PKR and have undeniably dominate party policies and decision making, the nons like Tian Chua and his Chinese coriander dressing, wakakaka, don't. And precisely because of this, he and his 'yim sai' cohorts wakakaka want so desperately to demonstrate their relevance in the party.

That's because Tian Chua fears his Heavenly Snake (wakakaka) faction in PKR might not have a role at all, or at best only a token one, if Anwar Ibrahim were to see DAP as the Pakatan component to be given responsibility for Chinese and Indian majority constituencies.

Tian Chua's fear crystallized into reality when Anwar agreed to Uncle Lim standing in Gelang Patah in the 2013 general elections, and our police-biting martyr-wannabe made that issue into a contentious one within PKR, as reported in the Malaysia Chronicle’s MUTINY IN PKR: Anwar under fire for "betraying" members over seats. And someone told me Tian Chua is virtually running the Malaysian Chronicle, wakakaka.

Anyway, going back into the troubled history of PKR, especially its Chinese section, wakakaka, prior to 2008, in order to prevent such a terrifying Pakatan status quo, that of Anwar accepting DAP as the Pakatan component party to be given responsibility for Chinese and Indian majority constituencies, Tian Chua (together with the Dwarf) had the very naughty, nasty and nauseating habit of making pre-emptive announcements against DAP in seat allocations, by making unilateral media releases of seat allocations for Pakatan (not PKR) which strangely, that is if you believe in coincidences wakakaka, usually favoured PKR.

Of course those 'unilateral' announcements meant that DAP leaders would, after reading the morning news, invariably exclaim 'WTF!' wakakaka.

Alas, despite all its pre-emptive strikes, the general success (or lack of) by PKR in elections has been noticeably inferior to DAP, even in Sarawak wakakaka, and coupled with the avalanche-like dominance of DAP in the Penang DUN, have dampened their (Chinese) members' confidence severely.

Thus it was hardly surprising these PKR members in Penang had prior to the 2013 general and state elections desperately sought Mansor Othman's assurances that he would not relinquish any of PKR's seats allocated in 2008, even the ones they lost, to DAP.

A second probable reason could be his intention to compromise DAP as a covert hudud supporter, despite this being very much contrary to the war of words over the past couple of weeks between DAP and PAS, so as to mitigate PKR's eventual declared support for PAS' plans to implement hudud in Kelantan, a la marilah, kita bersama-sama mati lah, wakakaka.

But whichever reason he has in mind, what do you expect from a man who would bite a policeman, wakakaka.

PAS janganlah tembak, janganlah main poker bluff!

There's a Penang Hokkien phrase called 'pnee been'.

'Pnee' means 'action' or 'become' or 'do/make something' like in 'pnee kui pnee kwai' which literally means 'become the devil and do something weird/eerie', but figuratively would translate as 'up to something naughty or mischievous'.

'Been' is of course 'face' where 'boe been' literally means 'no face' or figuratively 'lose face'.

Back to 'pnee been'. Figuratively it means 'turn nasty/ugly or unfriendly'.

Well, yesterday FMT reported that Pak Haji Hadi Awang, at a fund raising event held at the Pusat Tarbiyah Islamiah Kelantan (Putik), told PKR You have no right to block hudud. It was unmistakably a 'pnee been' statement to PKR.

But some have been puzzled with what they see as Pak Haji's misdirected 'pnee been', because Anwar Ibrahim's party or rather his wife's (wakakaka) party had not made any stand yet on PAS' intention to implement hudud in Kelantan.

It has been the other Pakatan component party, DAP, whose several leaders have told PAS publicly DAP won't support or disagree with PAS' hudud intention.

Anthony Loke has even told PAS to leave Pakatan if the Islamic party insists on having hudud in Kelantan, though I wonder whether Anwar Ibrahim and PKR would agree to Loke's call to PAS to f**k off if it pursues the issue of hudud because that will put an end to Anwar's dream of becoming PM - yes, he still holds on to that dream even as he knows he'll end up shortly in jail.



Today, DAP is outraged at Pak Haji's claim that Pakatan’s top council gave blessings for PAS’s hudud plan. News channel Astro Awani had reported Pak Haji as saying: “We have talked about this being the right of PAS leaders. We had issued a joint statement involving Pakatan Rakyat leaders that PAS’s right should be respected because this agenda came before Pakatan Rakyat existed.”

DAP leaders repudiated kau kau his claim, as reported in TMI's DAP leaders deny Pakatan’s top council gave blessings for PAS’s hudud plan.

Lim Guan Eng and Gobind Deo want Pak Haji to show proof of such an agreement, with the latter saying:

"This claim is totally untrue. The common agenda of Pakatan Rakyat signed by Hadi himself clearly excludes hudud. In addition, DAP has always made it crystal clear that it is totally against hudud as it is unconstitutional and unsuitable in a multiracial country like ours."


TMI reported that: Gobind also repeated a call by DAP's organising secretary Anthony Loke on Friday that PAS should consider pulling out from Pakatan Rakyat if it wanted to go ahead with its hudud agenda.

"If it is true, then perhaps PAS should seriously reconsider the relevance of its continued existence in Pakatan Rakyat."

Gobind reminded PAS that it had never made hudud as part of its general election campaign last year.

"PAS cannot now twist the facts and try to justify the push for hudud in Kelantan. Quite apart from the fact that it clearly violates the Federal Constitution, PAS ran its campaign without saying at all that it would implement hudud in Kelantan or elsewhere.

Gobind Deo explained that has been why voters had given their strong support to PR which had not made hudud as part of the coalition's agenda.

As I mentioned in my previous post The real objective of PAS' Hudud, PAS has this naughty Anwar-ish impatient but premature habit of jumping the gun when it believes it could smell success.

And I provided three examples of its 'pnee been' (turn nasty/ugly) characteristics, one being the during the campaign leading up to the 2004 general elections when it attempted to hijack the then public sympathy for poor Dr Wan Azizah to run away with its own Islamist agenda (and flopped badly together with PKR), ...

..... the second being its nasty selfish hijacking (again) of Kota Damansara state seat for PSM (as agreed by Pakatan) which ended up in BN winning a sure Pakatan seat if there was no 3-corner fight, ...

..... and thirdly, the most 'pnee been' of them all in 2012 when Allahyarham Harun Taib with unbelievable arrogance declared that PAS would team up with 'other pacts' (how many pacts are there in Malaysian politics?) to implement hudud if Pakatan won't play ball.

Nonetheless it's still sad (if the Astro Awani news report has been true) that Pak Haji would descend to such level to (in Gobind's words) 'twist the facts and try to justify the push for hudud in Kelantan'.

Just a reminder of what happened in May 2012, let us refer to the Malaysiakini's news report then, PAS to Karpal: Let's celebrate our differences, which tells us that in a PAS press conference that:

PAS president Abdul Hadi Awang sidestepped queries about Karpal's demands for Pakatan to thrash out the matter, and instead said Pakatan should focus on common goals.

"This issue does not arise. Our concept is to continue with Pakatan and focus on common issues such as poverty eradication, fairness, Islam as the federal religion, Malay special privilleges with the rights of others being protected and constitutional monarchy.

"These is the concept that we have agreed upon. There are differences, but we will celebrate these differences among ourselves," he told the press at the PAS headquarters.

Asked to comment on the party's stance on whether it will implement hudud law if it came to power, Hadi replied: "I have made official statements many times, there is no need for me to repeat, for now we would like to focus on the present."

That (hudud), can wait when we are in power, we are not yet in power. For now let us focus on the challenges in front of us which is the general election," he added.


Well, he certainly has since changed 180 degrees from his "let's celebrate our differences" message to our late Bhai.

Perhaps this could well be an additional reason to what I wrote yesterday in The real objective of PAS' Hudud. Maybe PAS somehow believes with Bhai gone, there is no longer any DAP objection to the Islamic Party's hudud aspiration.

In 2012 I had written the following:

What [Allahyarham] Harun Taib has said was just unmistakably this: If Pakatan wins in GE-13, and PAS has a sizable number of federal MPS, it will if necessary combine with UMNO (and perhaps the Chosen Ones of PKR) to implement hudud.

You can spin it any which way you like, like Hadi Awang’s sweet nothing Let's celebrate our differences to Karpal Singh’s voiced concerns about PAS’ hudud intention, but there's no mistaking PAS' openly voiced intention to jettison the alliance like a used tissue paper, of course after it has already won enough seats with support from (DAP/PKR canvassed) non-Muslim votes.

The problem with celebrating the 'difference' Hadi Awang alluded to, namely hudud, is that once the Islamic legal system has been implemented, non-Muslims will discover too late it's not something they will imagine celebrating, assuming that celebrations, especially those of non-Muslim variety like Valentine’s Day, concerts by foreign artists, wearing of lipstick and perfumes, Lion Dances, dancing, Thaipusam, Cheng Beng, etc, will even be permitted.

In fact we had had the misfortune to experience PAS' usual arrogant impatience in both Kelantan and (under Allahyarham Azizan Abdul Razak's) Kedah where PAS intruded into non-Muslim areas of activities like unisex hair dressing salons and koe-tai's, etc.

Therefore, those apologists who have attempted to dismiss Karpal Singh’s (and my) concerns by arguing that it won’t affect non-Muslims or that if non-Muslims have done nothing wrong they shouldn't be worried about hudud, have not convinced any of us, more so when we have witnessed in so many other nations ruled by syariah-hudud laws that such laws in the hands of unaccountable clerics have oppressed rather than protect the rights of the ordinary people.

Please name me one, just one Islamic nation anywhere in the world, as a model of good governance, and a nation where social justice, human rights and democratic processes are upheld.

Thus, we will see hudud invariably and severely affect the lives of non-Muslim Malaysians, regardless of what mealy-mouthed promise PAS may offer to non-Muslim voters.

Incidentally lawyer-blogger Art Harun has written a very important article on the Malaysian Constitution and hudud in The Star Online's Hudud and the basic-structure doctrine.

Art Harun raised a constitutional case which occurred just a mere 6 days before the formation of Malaysia, a 1963 merger of Malaya, Singapore, Sarawak and Sabah (and f**k Brunei).

Coincidentally, the plaintiff was the state of Kelantan. Art Harun wrote:

... six days before the formation of Malaysia, Kelantan sued the Federal Government of Malaya and Tunku Abdul Rahman for, among others, a declaration that the Malaysia Agreement and the Malaysia Act were null and void and not binding on the state.

Kelantan argued that the Malaysia Agreement was invalid because:

i) it violated the 1957 Federation of Malaya Agreement when Malaya was formed and the state agreed to be part of Malaya;

ii) its consent (and that of other states) was never given for the Malaysia Agreement;

iii) the Sultan of Kelantan should be a party to the Agreement;

iv) the Rulers were never consulted;

v) Parliament had no power to legislate over the matter.

To cut a long story short, Chief Justice Thompson, who heard the matter, held that the Malaysia Agreement and Malaysia Act did not in any way contravene the Federal Constitution and therefore they were valid and enforceable.

What is more important about this case is what CJ Thompson said in his judgment:

“In doing these things I cannot see that Parliament went in any way beyond its powers or that it did anything so fundamentally revolutionary as to require fulfilment of a condition which the Constitution itself does not prescribe, that is to say, a condition to the effect that the state of Kelantan or any other state should be consulted”.

That statement by CJ Thompson lays the basic-structure doctrine in constitutionalism.

Basically, what it means is that notwithstanding the powers of Parliament to amend the Constitution, it can never amend the Constitution in such manner which is so fundamentally revolutionary as to change the basic structure of the Constitution without inviting the fulfilment of “a condition which the constitution itself does not prescribe”.

So, the judge was saying if a proposed amendment is so fundamentally revolutionary, Parliament can’t merely amend the Constitu­tion without fulfilling other conditions which the Constitution itself does not prescribe.

The learned judge's ruling was backed up by other legal experts.

Art Harun said that while the formation of the Federation of Malaysia did NOT do anything so fundamentally revolutionary as to require fulfilment of a condition which the Constitution itself does not prescribe, the implementation of hudud will, whether in a state or federally.

Art Harun concluded: ... any proposed amendment of our Federal Constitution or state constitution to introduce hudud law or to change the criminal judicial system – whether applicable to Muslims only or otherwise – to one which is syariah based would be beyond the power of Parliament or the respective state legislative assembly to entertain or approve.

The change to hudud or syariah laws would undoubtedly change the basic structure of the administration of the criminal justice system which the states and all the people of Malaysia have agreed to be bound by from day one of the federation. Parliament and all the state legislative assemblies therefore have no right or power to so amend the Federal Constitution or their respective state constitution to effect such a fundamentally revolutionary change.

In fact, Art has wise advice for us when he stated: If PAS says they will implement hudud if Pakatan Rakyat wins Putrajaya, they are either lying or they are idiots who do not know the provisions of our Federal Constitution. Or both.

Hudud is a matter concerning or relating to the affairs of Islam and Muslims. Being so, this matter comes within the jurisdiction and purview of the respective state legislative assemblies. The Federal Government and Parliament do not have the power to impose hudud on Malaysia or any of the states.

If PAS wants to implement hudud in Malaysia as a whole, it must therefore take over ALL the states in Malaysia. So, dear PAS, don’t simply tembak.

I love the last bit when he told PAS, don’t simply tembak, wakakaka.

And may I add a comment to the bullshit about Pakatan giving its blessing to PAS' hudud aspiration (assuming the Astro Awani news report has been correct) and which made DAP mad, janganlah main poker bluff, okay? 'Ni haram tahu! wakakaka.

The real objective of PAS' Hudud

As many have written, PAS should be focussing on crimes, corruption, racism* and injustice in Malaysia rather than introducing an Islamic penal code, Hudud, which is viewed at best with distaste and in the worst case scenario with much fear, because Hudud's punishments would generally be irreversible.

* I doubt many in PAS would bother about this as they have shown themselves to be Malay nationalists rather than Islamist.



Yes, Hudud's punishments are generally irreversible because, for example, once a hand is chopped off, can the mullahs guarantee they have the bio-technology to grow one back for the punished victim if it were to be found later than the victim had been wrongly and unjustly punished - and that would be the same as saying no appeal or legal review would ever be successful, even if allowed.

We have already witnessed in the infamous Qatif (Shia) girl case in Saudi Arabia how the Saudi syariah court horrendously punished a rape victim (yes, a rape victim, not the rapist) with flogging and imprisonment, and then increased that unjust punishment when she appealed, and threats of further increased punishments to deter her from any further appeals.



We have witnessed in Pakistan how a raped victim Mukhtaran (Mai) Bibi was constantly harassed by authorities to withdraw her rape police report, and how 5 of those 6 culprits eventually got away with it, with one having the mandated death sentence reduced to life imprisonment (which in real terms is as good as a less than 10 years sentence). We also witnessed how Pakistan's then-president denigrated her credibility by suggesting to western press that some Pakistani women would claim to be raped so as to migrate to Canada.

In both the Saudi and Pakistani cases, it was the USA (under pressure from its own citizens) which came to the victims' rescues, and not because of those countries judiciaries.

In Malaysia as yet without hudud, we have also witnessed how an Indonesian Christian woman has been charged with Islamic apostasy - who if hudud was in place in our country, would have seen her executed under the Malaysian Shafi'i school of Sunni Islamic jurisprudence.

Today, PAS has effectively broken its concorde with DAP, or more correctly DAP has in the most blunt manner, without any ambiguity or tap dancing, told PAS to leave Pakatan if it still insists on introducing hudud - see Malaysiakini's Quit Pakatan if set on hudud, DAP MP tells PAS.

DAP organising secretary Anthony Loke, stressing that DAP is not anti-Islam, nor has it ever belittled Islamic laws or used the issue to stoke fear among non-Muslims as had been done by MCA leaders, was reported to have said:


PAS should quit Pakatan Rakyat if it wanted to act on a unilateral basis regarding this issue.

If PAS is adamant in making decisions which do not have consensus in Pakatan, then the most honourable and rational move would be for PAS to withdraw from Pakatan.

DAP’s stand on this matter is common knowledge and it would not agree to the implementation of hudud because it is impractical and unfitting for a multiracial nation.

How can laws be enforced effectively if there are two sets of laws applying for Muslims and non-Muslims. Crime is not related to skin colour or religion.


These are delightful music to my ears but which no doubt would have driven 'someone' up the wall, wakakaka.

But I have to recognize that DAP must have been pushed painfully to the wall to arrive at such an unambiguous statement, one drawing a non-negotiable red line in the sand. The issue of PAS' incessant push to implement hudud is far far far too f**king dangerous to tolerate even if it means abandoning the political alliance with an anyway-unreliable ally.

My favourite English-language blogger (wakakaka) Azly Rahman, has this to say (extracts only):

..... inability to sustain arguments on matters requiring rationalistic and humanistic perspectives, and above all, the inability to look at the bigger picture of corruption, abuse of power, and race politics as crimes against humanity themselves requiring more that just amputation, public flogging, and stoning to death as antidote - and these horrible crimes are carried out by those projecting piousness in public themselves [...]

We are yet to discuss the origin and genealogy of the thinking of the groups urging an ‘Islamic state’ in terms of their education and the influence gathered and harnessed into political parties that ultimately will only .....

And that's what we all fear!

Azly continued:

Indeed, as we have also witnessed in Saudi Arabia, and even Malaysia!

If the hudud is such a questionable form of punishment and its implementation vis-a-vis the number if witnesses required to convict, increasing from two to four, why is there a need to urge its implementation when, even different schools of thought have not resolved the issues surrounding the history of its evolution, as well as the subjectivity of the sources by which the law is derived from.

In Malaysia, it is as if the word ‘hudud’ is used as a political bogeyman to scare off non-Muslim as well as Muslim voters. Is there sincerity in implementing the “no-longer-suitable ordinances for this age and time”?

Ultimately, too, who amongst the ‘ummah’ who hath not sinned shall cast the first stone?


And RPK has quite succinctly said that in matters of religion whether Islam or Christianity, there can be NO logical argument or discussion.

So, rather than argue against Hudud, we need to ask, why does PAS want hudud when as stated by Azly Rahman, If the hudud is such a questionable form of punishment and its implementation vis-a-vis the number if witnesses required to convict, increasing from two to four, why is there a need to urge its implementation when, even different schools of thought have not resolved the issues ...

Consider, it hasn't as yet attended to issues of corruption, crimes, racism (wakakaka), social injustice etc. Maybe it couldn't be bothered to?

Also consider, 5 of the top safest countries in the world, Singapore, Hong Kong, Taiwan, Korea and Japan, adhere to principally Confucian practice cum secular laws and not Islamic syariah-hudud. Tell me, is there a message somewhere here?

Okay then let me attempt to answer why PAS has been so insistent about its hudud implementation, even if it means abandoning Pakatan, its erstwhile key to Putrajaya.

Firstly, PAS sees the opportunity is now, when there is internal strife in both UMNO and the UMNO-section (wakakaka) of PKR, when it can now put the pressure of 'who-is-holier' on the politicians of those two parties, and DAP can go f**k the Pakatan spider even the one belonging to Miss Muffet, wakakaka.

Secondly, the history of PAS' impatience has been witnessed several times, as seen in the campaign leading up to the 2004 general elections when it became unbearably arrogant, and as recent as the Kota Damansara debacle in 2013 general elections.

I notice PAS would move in on what it believes to be a sure political kill when it (thinks it) senses political opportunity as sharks and piranhas sense blood.

Recall its over-bearing hubris in May 2012 when the late Harun Taib, PAS’ former Ulama Chief said about Hudud if PAS wins more seats than allies. And that was regardless of whether Pakatan had arrived at a consensus about hudud.

While that declaration by itself, that of embracing hudud, had not been new, and a known aspiration of PAS, what was then far more worrying was Harun Taib’s assertion that PAS would implement hudud regardless, as evident in his reported words “… if not with the current partners we have in Pakatan … may be there will be other pacts that will lend us their support …”.

I don’t like to criticize someone who has long gone but if that didn't smack of arrogant go-it-alone-after-winning treachery, what was it then? What kind of coalition partner would PAS be?

Anyway, let’s re-examine what Allahyarham Harun Taib meant by his arrogant words of “… if not with the current partners we have in Pakatan… may be there will be other pacts that will lend us their support …”.

Pray tell me, what 'other pacts' would possibly lend PAS their support for hudud in the event of a Pakatan victory in GE-13 but with a DAP (or even PKR) refusing PAS its demand?

Now, what was that remarkable political term so loved by PAS people like Hadi Awang, Nasharudin Mt Isa, Allahyarham Azizan Abdul Razak and (lurking or just standing by in the nearby shadow) Hasan Ali?

Malay unity! Specifically one with UMNO!

There was no mistaking PAS' (2012) openly voiced intention to jettison the alliance like a used tissue paper, of course after it had already won enough seats with support from (DAP/PKR canvassed) non-Muslim votes. I raised the alarm but most Pakatan people told me to f**k off, wakakaka.



And may I say, Alhamdulillah, PAS didn't win as much as it had anticipated or fantasized, wakakaka.

Today it's fluttering the same eyelashes at Najib and his UMNO, wakakaka.

Thirdly, I believe PAS's real objective, as to why it has been so adamant about bringing in hudud is ..... actually has already been stated by Azly Rahman, namely:

The image of those calling for the implementation of the hudud in Malaysia is one of intolerance to varying viewpoints, condescendingness, enforcing others to follow this or that fatwa even if these injunctions are merely opinions, subjugating the mind of the gullible especially in schools populated by Malay-Muslims, ...

and 

..... operate within the paradigm of the setting up of a theocratic state; one that will limit freedom of expression, of assembly, to petition, of press, and to revolt against an unjust State, even if the State has by then evolved into a Talibanistic one shooting helpless little schoolgirls in the face and legalising marriage for nine year-olds.


That's how Nazi Germany controlled its people, through threats of painful and/or fatal consequences by its Gestapo and SS, and how Iran and Saudi Arabia do likewise!

Argue and you can lose more than an arm and a leg (excuse my pun) or as per Qisas, even an eye, or your life.

Fear as a doctrine, especially a religious doctrine, for state control has been eternal, since the time of the biblical Moses and Samuel through the ages to Robespierre's France, Hitler's Germany, Stalin's USSR, Pol Pot's Kampuchea and Ayatollah's Iran, etc.


Once hudud is implemented, initially in Kelantan and finally throughout the states of Malaysia, the mullahs will be unquestionable, unimpeachable and probably eternal in their draconian rule. This is the real objective.

PAS and its love of hudud

KUALA LUMPUR, April 23 — Faced with unyielding resistance from its allies in Pakatan Rakyat (PR), PAS said it will have to turn to its political foes in Umno to push through a controversial bill in Parliament that will pave the way for the implementation of hudud in Kelantan.

Without support from Umno, which PAS has in the past repeatedly refused to form a unity government with, the Islamist party will suffer yet another setback in its long-time struggle to introduce hudud, likely inviting more criticism on its commitment to Islam.


Under syariah laws, hudud is the section dealing with a class of 'crimes' and its punishments. The class of crimes include theft, fornication and adultery, consumption of alcohol or other intoxicants, and apostasy.


As can be seen, other than theft, the rest of the Islamic 'serious crimes' mentioned above are no longer considered crimes from a legal point of view in a secular or even non-Islamic religious world.

Certainly acts such as adultery would be morally and socially unacceptable but the most the 'moralizers' could do would be to either sermonize or frown on it, or both. Society could of course socially (but not legally) ostracize the offenders - that's the max.

But in Islam, the punishment for adultery is death by stoning whereas fronication earns 100 lashes and/or exile for a year ... and would be even worse and totally unjust if you're a Shiite woman in a Sunni country as was seen in the case of the Qatif girl in Saudi Arabia. The victims (a Shiite girl and a man), after being gang-raped by seven Saudi Sunni men (yes, the male victim was also buggered), were each sentenced to be flogged with 90 lashes and two months jail.



PAS has long been obsessed with hudud. If you read a wee bit about hudud, with its execution by decapitation with the sword, stoning to death, amputation of arms and legs, and flogging, you wonder at the mindset of its PAS proponents.

And the frightening thing is that religious laws (of all religion, not just Islam), purportedly from God, would actually be framed, decided, judged and dispensed by man. Thus, under a theocratic legal system, it'll no longer be a case of 'man proposes, GOD disposes'; instead and in reality it would be 'god proposes, MAN disposes'.

Don't believe me? Read the history of Jeanne d'Arc, and examine this list of unfortunates who were burned by the Roman Catholic Church, Church of England, Eastern Orthodox Church and Calvinist Church. Over in the Americas, the list would probably be even longer.

But so obsessed has been PAS in wanting to bring into our legal system this medieval code of punishment that they would even sleep with UMNO, whom they have described as evil and apostates, wakakaka.

And why is hudud considered medieval?

Judaism used to stone adulterers to death - recall John 8:7 which says "So when they continued asking him, he lifted up himself, and said unto them, He that is without sin among you, let him first cast a stone at her", but it no longer does.



The Chinese used to drown adulterers in the nearest river or pond but they no longer do.



But the code of punishment in hudud has not changed since its inception nearly a thousand years ago.

In Saudi Arabia which has syariah as its legal system, apart from hudud, there is also a subset of laws called Qisas - if this legal system allowing retaliation a la 'an eye for an eye' is not medieval and of tribal origin, I'm not sure what it is.

But it's not God's law we are worried about; it's those mullahs, muftis and MF's that we are scared of. And you can be sure they will be the very group coincidentally exempt from the worst punishments of hudud.

We'll just have to wait and see whether UMNO and the UMNO section in PKR will play ball with PAS.
